MSNBC column argues there is no constitutional right to own a gun

Comedian Dean Obeidallah wrote a column for MSNBC on Saturday that argued the right to own a gun was decided by a "cravenly political" Supreme Court rather than the U.S. Constitution.

As several media outlets attacked supporters of the Second Amendment as "barbarians" in the wake of a mass shooting in Texas, Obeidallah insisted that it was the 2008 Heller case that decided that owning guns was a "constitutionally guaranteed right."

"But even if such laws were to be enacted — on either the federal or state level — there’s one big problem: the 2008 U.S. Supreme Court decision District of Columbia v. Heller, in which the court, in a 5-4 decision, essentially rewrote the Second Amendment to create a constitutionally guaranteed right for an individual to possess a gun," Obeidallah wrote.

Obeidallah argued while the Second Amendment referenced the right to "bear arms," it wasn’t until the 2008 court decision that the nation decided to codify "an individual’s constitutional right to have a gun."

If the framers wanted to create a constitutional right to gun ownership, then they would have made the Second Amendment a mirror of the First Amendment," Obeidallah wrote.

Missed a line in the last paragraph. It should read:

"James Madison drafted the Second Amendment, and in his notes from the 1789 Constitutional Convention, there’s not a single mention of an individual’s right to possess a gun for self-defense or recreational use. If the framers wanted to create a constitutional right to gun ownership, then they would have made the Second Amendment a mirror of the First Amendment," Obeidallah wrote.

The Second Amendment says “the right of the people to keep and bear Arms, shall not be infringed”.

What are “Arms”, in this context. The common definition in effect at the time was that “arms” was a generic term for “weapons”. The Second Amendment does not just codify the right to keep (posses) but also to “bear” (carry with you in public) all kinds of arms. Not just firearms, but also knives, bayonets, swords, etc.

In all of the founding fathers notes from the 1789 Constitutional Convention, there’s not a single mention of an individual’s right to abortion. If the framers wanted to create a constitutional right to abortion, then they would have an amendment which was a mirror of the First Amendment,"

For many years since the founding of this country, the right to keep and bear arms was largely unquestioned. It was only after the freed slaves in the South acquired guns, that the local “Protectors of the people” (the KKK) sought to have the black citizens deprived of any kind of gun, and as the nation was further urbanized, with the rise of organized criminal cartels, were the first cries for “outlawing” guns of all kinds becoming prevalent. The period of Prohibition made the various misuse of weaponry, including Tommy guns, so egregious, that the Federal government enacted prohibitions on certain classes of weapons.

Drinking and gunplay do not mix.

A well-educated electorate, being necessary to the security of a free State, the right of the people to keep and read Books, shall not be infringed.

Clearly they believe ONLY the well-educated are permitted to read books, right?
