AUSTIN, Texas (AP) — Forty years after the U.S. Supreme Court upheld the right to a public education for all students regardless of legal status, Texas Gov. Greg Abbott says that decision is another longstanding precedent worth challenging.
Here’s what to know:
WHAT WOULD TEXAS CHALLENGE?
The requirement that public schools teach all children was affirmed by a 1982 ruling in a case known as Plyler v. Doe. The 5-4 decision struck down a Texas law that sought to deny enrollment to any student not “legally admitted” into the country.
WHAT DID ABBOTT SAY?
Abbott said the crux of the argument would be that the federal government should foot the bill amid the high numbers of migrant crossings.
WHAT’S BEEN THE RESPONSE?
Immigration rights advocates, Democrats and the White House bristled at Abbott’s remarks.
One of the groups behind the Plyler case, the Mexican American Legal Defense and Education Fund, said Abbott was trying to inflict harm the court sought to avoid decades ago.
WHAT’S NEXT?
Abbott gave no timeline of when or how Texas might bring a new challenge. Any new law drafted by Republicans would have to wait until 2023, when the state Legislature returns.

It’s a horrible decision that should be reversed. The Court at the time said there was no “rational basis” - the lowest possible level of scrutiny, for not providing a free education to illegal immigrants. Like...cost, maybe?
I don't think there's a lot of disagreement that a educated population makes everyone, including government, richer.

I have very mixed emotions on this issue but I’m inclined to believe the risks associated with a large totally uneducated population is just too high. They are not likely to be exported. It’s a pay me now or pay me later deal.
He also needs to add the lawsuit that the Tennessee legislature fought for years over Medicare for all the refugees. Wound it’s way thigh court for years.
Some hack judge finally tossed it saying the legislature had no standing since the AG and Governor weren’t plaintiffs as well. Even though the people of Tennessee were the plaintiffs.
I think there are close to 30 states that are controlled top to bottom by Republicans. Everyone of them should sign onto this suit.

General George Washington’s soldiers generally lacked a public K-12 education.
Public education was greatly enlarged in the 1840s so the Pope would not have overwelming influence.

We already have that. It’s called leftist democrats with college diplomas.
The issue is whether the US Constitution requires that local governments pay for the free education of illegal, or whether the citizens of this country should be entitled to vote on that.
The legal reasoning in that case used to justify the result was laughably bad. The only reason the justices came out that way was because that was the policy result they preferred.
What I can’t figure out is why Illegal Immigrant children should be subjected to the SCUMBAGS that operate in our public schools. It’s one thing when Americans knowingly subject their kids to these scumbags (since the schools are ‘free’, don’t you know), but it’s a crime against humanity to subject kids from other countries, who almost always were dragged here by others, to these public school scumbags.
Of course it does if the alternative is they don't get educated.
I don't know how you make a living but I'd wager you, your employer or your customers, or all three require an educated workforce to survive.
How successful do you think a company that can only hire uneducated people would be?

I do, every time I pay my property and other taxes.
And I'm happy to do it even though I don't have any kids in public schools. Because I think things would go to hell if we stopped sending kids to school.
That there is a good joke. What evidence can you provide to show that the current eduction system provides any education? The majority can’t read or do grade school math on graduation especially in areas where illegal alien children make up a high % of the children. Many don’t even learn English.
You also seem to take it as a given that these illegal alien children will be in the USA permanently. They need to go home and the USA needs to stop being an attractive nuisance, a disservice to the home countries, the illegals and to American citizens.
There are school districts in Texas where up to 40% of the students are here illegally. That is a tremendous, disproportionate burden to put on the taxpayers of that district. It is highly unlikely that those particular taxpayers will reap 100% of the benefit that may come from educating those students even though they are footing 100% of that bill.
And obviously, they would not magically become more wealthy if the number of illegal students doubled. At the very least, shouldn't the taxpayers of that district make that decision, and have the opportunity to vote on whether they should have to pay more taxes to educate illegals?
As to the second point, there is no evidence that spending $50k to educate an illegal immigrant will make them a better unskilled/low-skilled/unemployed worker. Especially given that the left is advocating for Universal Basic Income because we supposedly don't have enough jobs to go around as it is.
Finally, free education is one of the big magnets that induces illegals to enter the country in the first place. We should be removing such incentives, not keep the going in perpetuity.
The results of the 2021 State of Texas Assessments of Academic Readiness, the Texas standardized tests, indicate 36% of Texas fourth grade students scored at or above grade level for reading.
The percentage of fourth-grade students reading at or above grade level declined from 2019 to 2021. In 2019, 43% of students were reading at or above grade level.
At the Austin Independent School District, 30% of 7th graders “did not meet” standards for reading. That number jumped to 45% in 2021. The discrepancy was even more heightened for mathematics. In 2019, 44% of 7th graders “did not meet” expectations. That number jumped to 72% in 2021, meaning nearly 3 out of every 4 7th graders were not at their understanding their concepts appropriate for their grade.

Why should it be disproportionate? The property tax collector doesn't care if you're illegal or not - he collects the taxes.
Now if there's a large population of uneducated people with no job prospects the quality of life in the district is going to go downhill, as will the property values. Everyone loses.

I think there's plenty of evidence people get better jobs when they're educated. It may even allow them to get a more skilled job, make some money and pay more taxes.
