The Constitutional Crisis That Roe v. Wade Set In Motion Is Now Upon Us
The Federalist ^ | 4 May 2022 | John Daniel Davidson

Posted on 05/04/2022 6:25:51 AM PDT by Rummyfan

Roe sowed the seeds of a crisis that will end with America ceasing to be divided: we will become all one thing or all the other.

The leak of a draft majority opinion of the U.S. Supreme Court overturning Roe v. Wade and Casey v. Planned Parenthood — and with it our 50-year regime of legalized murder of the unborn — has rightly captured the nation’s attention. It is without question the most important news story in the country, and, if the draft decision stands, the most important political development in a generation.

But it is also more than these things. Whether the draft opinion stands or falls, this is a great moment of moral clarity for the nation — and a time of great peril. Now we see, as we rarely have over the past five decades, the severity of what Roe inaugurated in 1973 and Casey sustained in 1992.

By snatching the question of abortion from the American people and their elected representatives, and doing so with such shoddy jurisprudence that it has since distorted many other areas of constitutional law, Roe divided the nation and sowed the seeds of a constitutional crisis. The contours of that crisis are now coming into view.

What’s clear already is that the left is willing to destroy every institution of American civic life to preserve their abortion regime. The day after the leak, the president of the United States, a man who once pushed for a constitutional amendment to overturn Roe but has since surrendered to the demands of his party’s ascendent left wing, took the extraordinary step of weighing in on an undecided Supreme Court case. (While he was at it, he spouted exactly the kind of nonsense we have come to expect from him.)

Now do Obamacare. The “egregiously wrong from the start” is already in the template.

I disagree with the point made by the headline. The decision just means that instead of fighting over judicial confirmation, abortion will become bitterly contested at the state and federal level (at least unless/until the Court decides only states, not Congress, can regulate abortion.).

But in any case, we won't be any more unified then than now.

This is why the Left is proud of the 2020 Steal and feel no guilt whatsoever.

The ends justify the means. Anything is on the table. They fight hard and take no prisoners.

If only the squish republicans had half that fight in them.

Hopefully the primaries this summer will eliminate the squishes and replace them with MAGA folks with a backbone.

The purpose of Roe v. Wade is not to allow women to have abortions.

The purpose is to destroy the Constitution, by showing it is immaterial.

Allowing abortions is just a symptom of the Progressive agenda, which is to eliminate the checks and balances to preserve limits on government.

And do homo marriage. As states must reciprocate it must be abolished. This newspeak redefining marriage has been, as predicted, devastating. Religious freedom potentially abolished.

***** Now do Obamacare. *****
They should overturn the gay marriage decision, which was almost as bad as Roe.

Reminder to everyone: really bad things happen when governments pretend things to be true that are not true. Some examples:

- Pretending that are witches are real.
- Pretending that black people aren’t people.
- Pretending that Jewish people aren’t people.
- Pretending that pre-born people aren’t people.
- Pretending that homosexuality is normal.

Isn’t that cute that people are still pretending we have a Constitution.

The Constitution was shredded the day ALL of our elected AND appointed swore in the ineligible Kenyan from Indonesia.

Natural born citizens are NATURALLY citizens because they could not be anything else, born here of citizen parents.

Anyone born with foreign nationality is not NATURALLY an American because they were also born something else.

It was that singularity of nationality that the founders were requiring to prevent foreigners from being President.

The children of foreigners ARE born foreigners, even if we foolishly give them citizenship, too.

John Jay to George Washington:

“Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Command in Chief of the American army shall not be given to nor devolve on, any but a natural born Citizen.”

About time it only took them 50 years to find the facts.

The good old boy club tends to slow things down a bit.

"The intellectual architects of the Slave Power were honest about their project. They meant to overthrow the Constitution, which John C. Calhoun thought was based on the lie that all men are created equal."

The South didn't want to overthrow the constitution. They simply wanted their own country and to be left alone by the north. Once they seceded, that constitution he speaks of could not be affected by them.
