Tennessee passes bill requiring drunk drivers to pay child support if they kill a parent

The Tennessee legislature passed a bill Wednesday that would require drunk drivers to pay child support if they kill a parent and are convicted of vehicular homicide due to intoxication. The legislation passed through the Tennessee Senate on Wednesday following an amendment to rename the bill after the two daughters of state police officer Nicholas Galinger, who was killed in a hit-and-run by a drunk driver in 2019, according to CBS 46. The payments would continue until each child reaches 18 years old and graduates from high school. Galinger's killer, Janet Hind, drove into him from behind while he was investigating a manhole cover overflowing with water. Hind was intoxicated at the time and was sentenced to 11 years in prison in February.

Looks good on paper. But how is a convicted DUI killer going to provide restitution? If they have any money, it is likely the defense lawyers will have vacuumed up most of it before the judgement is rendered. Once the person gets out of prison, it is unlikely they will find any meaningful job that will provide restitution of any significance..

If this is legally bounded to drunk drivers, this is a just law, and really should have been in place in all states.

The obvious solution is for the government to mandate everyone install a sleep tracker app and wear a smart watch that police can check at random checkpoints to make sure they are not driving without meeting a minimum sleep score. At least until we can get the sleep monitoring brain implants online.

Next they should make anyone that’s at-fault for a wreck cause of texting or falls asleep liable too.

Well DUI does not mean Driving While Intoxicated it means Driving while Impaired. Reading or texting while you are operating a vehicle would definitely impair your ability to avoid an accident.

DUI means Driving Under the Influence, alcohol, drugs etc.

DWI means Driving While Intoxicated.
Some places have changed it to Driving While Impaired. Why? I don’t know.
Impairment usually means under the influence of something that alters your perception to things around you.

Driving while texting isn’t driving while impaired. It’s just stoopit.

Drunk driving is different. There’s no way this can connect to somebody doing something illegal (such as lying) to obtain a gun and some drunk - in his own car or that of somebody else who has voluntarily and knowingly loaned it to him - roaring out of the lot and mowing down innocent people.

I think it’s a good law.

IIRC, this was part of the reasoning that was used back when the government decided to force everyone to buy auto insurance.
I don't have any complaint about either action but the citizenry needs to be aware that this will not be the last government imposed requirement.

So if little Caligula fathers a child with a woman but never pays child support, is it okay if the father of the woman throws little Caligula in front of a drunk driver so his daughter can collect child support from the drunk?

There is already a civil remedy. One can always go after someone who deprives them.

I heard on radio that it specified the “breadwinner” being killed. So what if the housewife that doesn’t work...

More laws, more problems.
