I looked and from what I can see, it’s not illegal unless she were actually sworn in before he retires. I was curious about this, too.
The Constitution doesn’t say anything about how many justices, it’s up to Congress. There were only 6 until 1869.

Congress sets the size of the Supreme Court and not the Constitution. The court has been set at nine since 1869. Before that is was as small as 6 and as large as 10.
