BILLINGS, Mont. (AP) — U.S. officials improperly downplayed the climate change effects from burning coal when they approved a large expansion of an underground Montana coal mine that would release an estimated 190 million tons of greenhouse gasses into the atmosphere, a court ruled.
The 9th U.S. Circuit Court of Appeals said in a 2-1 ruling that Interior Department officials “hid the ball” during the Trump administration, by failing to fully account for emissions from burning the fuel in a 2018 environmental analysis.
A judge previously ruled against the disputed expansion of Signal Peak Energy’s Bull Mountain mine in 2017, but allowed mining to continue while a lawsuit brought by environmentalists proceeded.
Monday’s ruling sends the case back to the district court level to decide the fate of the mine’s federal permit.
It marks the latest in long string of decisions against the U.S. government going back to the Obama administration for failing to adequately consider climate damages from extracting and burning fossil fuels.
The appeals court faulted the government for comparing emissions from the mine against total global emissions. That approach “predestined that the emissions would appear relatively minor,” Circuit Judge Morgan Christen wrote.

Why is the 9th Circus still hearing cases involved in Montana? Break up the 9th Circus - let it handle the 3 left coast states, and the rest can be assigned to a new Circuit.

at an ever increasing rate that should not effect our
coal use?? We should cut back because China is continuing
to use coal as a source of energy???
Why does burning American coal in America damage the environment but burning American coal in
other countries like India, Netherlands, Japan, South Korea, Brazil and 50 other nations is okay?And why do democrats demand America stop burning coal while China, with 5 times the USA population,
is building 3 times as many new coal powered generating plants as the the rest of the world combined?
The whole issue of “climate damages” is one of the trojan horses these creeps are beginning to use in their lawfare attacks on civilization. Banks and businesses are being pressured to factor “damages” in to their financial calculations. It is called ESG scoring and it is malignant.
Judges need to be constitutionally required to first publicly reference specific constitutional clauses that reasonably justifies any challenged federal government action, the prudence of such action a secondary concern imo.

In the case of politically correct global warming, since the states have never expressly constitutionally given the feds the specific power to dictate policy for climate issues, the 10th Amendment automatically makes politically correct climate issues a state power issue imo.
Also, consider that the very corrupt, constitutionally undefined political parties have divided the Senate, effectively nullifying the Senate's power to remove House-impeached officials from office. This is evidenced by the Senate's failure to remove Trump from the Oval Office after two failed mock impeachments of him by desperate, alleged election stealing desperate Democrats.
The Senate's political party-crippled power to remove impeached federal officers undoubtedly gives activist justices and judges a sense of job security with respect to getting away with pushing politically correct agendas.

1. Models by leftist government agencies show “climate catastrophe”
2. Leftist environmental “activists,” using those models sue to stop fossil fuel exploration, federal land leases and resource production.
3. Leftist Federal courts uphold the leftist lawsuits predicated on the leftist predicted “climate catastrophe.”
Defeating this seems hopeless. Maybe when people cannot afford to drive or heat their homes will they wake up and rebel. But that would take an educated citizenry capable of understanding what is going on.
