Yep. And that’s a real sticking point. When does a “punitive expedition” or a “kinetic action” rise to the level of being a war?

As I think you would agree, all four were actual wars. But in each case Congress was too timid to declare war. So instead they passed resolutions to cover themselves. They passed the buck.

One reason I’m a bit obsessed with this is that we should go to war reluctantly. The whole “resolution” dodge circumvents that.

Article 5 of the NATO charter means it’s one for all and all for one. I doubt these troops go directly to Ukraine they are going to Poland or Germany first. If Russia enters and or attacks Estonia,Latvia or Lithuania article V is triggered no us Congress action needed they already ratified the NATO treaty that requires us to use military force. Poland is the trigger that’s where weapons are being staged at and Russia is perfectly in their rights to attack a nation providing military equipment to a belligerent in a conflict Poland has committed an act of war against Russia by supplying arms to Ukraine that’s long standing international warfare laws. For that matter the USA has also committed the same act of war in addition to declaring economic warfare which also is an international act of war. It’s up to the Russians how they take those acts of war against them but the fact remains we have declared via our actions a state of war between the USA and Russia it’s up to Russia if they want to formally announce a declaration of war for those acts or like we did in Vietnam not formally announce and fight a proxy war instead. It’s totally up to the Russians at this point the USA has cast our dice. The sooner people accept that and realise WWIII is already underway the sooner we can take the steps needed to win it. Trying to “cancel” Russia is a declaration of WWIII by those counties commiting those acts of economic warfare. It’s no different than an embargo by sea. Which is a outright act of war. That is why during the Cuban missile crisis JFK used weasel words to say it was a quarantine zone not an embargo since that would be a formal declaration of warfare against the USSR. A total economic blockade is orders of magnitude worse and absolutely an outright in your face declaration of war. We are at war with Russia by every convention of international warfare accept that it be left behind in what is coming.

Actually we entered WWI in 1917, two years after the sinking of the Lusitania. The German resumption of unrestricted submarine warfare was the catalyst. As for the cargo, the 4,200 cases of safety cartridges, 18 fuse cases and 125 shrapnel cases listed on the manifest were not considered munitions at the time. In any case I’m sure these were purchased by the British government from
American companies. Do you have any source proving the involvement of our government in those supplies?

But you’re right, Wilson did campaign on that basis.

Well, I can tell you what it means. Sending U.S. Army troops to fight the Russians in Ukraine means WWIII because that's how Putin would view it.

I can’t argue with what you posted. My purpose of posting on the minutiae of a declaration of war is to disabuse posters of the idea that we’ve somehow thrown out the old ways. Declarations of war have been infrequent. This is completely separate from any comment on the wisdom of any individual military action.

NATO is different the US Congress already ratified our treaty with them. In that treaty is Article V is all for one and one for all. No additional congressional action is needed if article V is triggered that approval is baked into the treaty that was ratified. Poland get attacked that triggers article V and WWIII goes fully hot. It’s already warm now. The foolish sanctions by the West are an outright act of war thus triggering WWIII it’s up to Russia and if we sanctions the Chinese if they formerly declare warfare in response but make no mistake embargos, economic blockades and freezing national level currency assets are all acts of war in international law going back hundreds of years.

You are wrong unfortunately the USA has already committed acts of war against Russia by supplying arms and our stupid STUPID economic warfare actions. We are at a state of war with Russia its only up to which side formerly declares it under international law. Sending troops is no different than embargoing shipping or seizing national assets outside the belligerents borders all are international act of war. Russia has the choice to keep it a proxy war like Vietnam where they sent troops into Vietnam and the USA ignored it to avoid a formal declaration of warfare against the USSR. In Vietnam we shot down migs with Russian pilots. Bombed Sam sites with Russian operators running them and our secops killed many a spetsnaz embedded with the VC. You can take it to the bank we already have American specops on the ground in Ukraine. The best hope is the war in Ukraine stays a proxy war like Vietnam and doesn’t go full hot into WWIII the lines have been drawn. It’s Russia China India Iran NK vs the West with the Arabs being the wild card.

The legalities of declaring war are significant. The President assumes power, the likes of which few of us would grant him. It also creates diplomatic entanglements, triggers treaties, and a whole bunch of stuff our government does not want to be constricted by—or that the opposition doesn’t want.

It’s easier to pick an isolated “target” and get an AUOF instead.

Our country is lead by a bunch of old panzies. They lie and profit off of the emotions.

The last thing this country needs is to get involved in another war, particularly with Russia. Putin, with the help of some very bad US foreign policy dating back to Clinton, has created a shit show that Russia cannot win and that he, Putin, likely cannot survive politically. When your “enemy” is making a mistake, you make some popcorn and enjoy the show, you don’t start making your own unforced errors and committing ground troops to Ukraine would be just that.
