Judge to New York AG: Sorry, You Can't Dissolve the NRA

The Left’s war on the National Rifle Association has been ongoing for months. New York Attorney General Letitia James has vowed to dissolve the organization through a series of legal actions aimed at exposing the allegations of fraud and corruption among the upper crust of the group. The NRA is one of the nation’s oldest civil rights organizations, though how they’ve spent their donors’ money, among other things, has drawn immense scrutiny. Some items purchased with these funds were not earmarked properly. A wedding does not enhance or promote Second Amendment rights. This has been a months-long saga, but a judge on the New York State Supreme Court has ruled the AG cannot nuke the organization (via The Reload):

New York Attorney Letitia James (D.) has been dealt a major setback in her corruption case against the National Rifle Association (NRA).

Justice Joel Cohen of the Supreme Court of the State of New York dismissed James’ attempt to dissolve the country’s largest gun rights group on Wednesday. He said James’ accusations of corruption primarily involved private harm to NRA members and donors, and thus did not warrant such a sweeping penalty if proven.

“In short, the Complaint does not allege the type of public harm that is the legal linchpin for imposing the ‘corporate death penalty,’” Justice Cohen wrote in his opinion. “Moreover, dissolving the NRA could impinge, at least indirectly, on the free speech and assembly rights of its millions of members.”

The decision comes after the NRA filed several motions to dismiss Attorney General James’ corruption claims against the organization and various individual members of its executive leadership. While the judge allowed several of the claims to proceed, dismissal of the threat to dissolve the organization removes James’ most potent weapon against the group.

Attorney General James launched her lawsuit against the NRA in August of 2020 after alleging that the organization, Executive Vice-President Wayne LaPierre, former Treasurer and Chief Financial Officer (CFO) Wilson “Woody” Phillips, former Chief of Staff and the Executive Director of General Operations Joshua Powell, and Corporate Secretary and General Counsel John Frazer all engaged in illicit conduct with NRA funds.

Dissolving the NRA was James’ main aim. She noted how she was disappointed that the judge took away the basis of her legal action, though a host of lawsuits still can be litigated. We’ll see what happens

NYC is just one huge mega corrupt sh*thole. I heard they just got rid of another Marxist punk appointed by Bill DuhBlasio who was pulling all kinds of crap with the Taxi and limousine commission. She was firing anyone who was white and male, apparently to “get rid of white supremacist patriarchy”.

That city is learning about “life after white people”, and it isn’t pretty. This isn’t something coming down the road; it is here now - and replacing one pathetic lazy white male slob of a mayor with a dopey token (”When the mayor has swagger, the city has swagger” - yes, he said that) just shows how far they have fallen. There is no more status to being the mayor of NYC; serious people don’t want the job.

Really, I see plenty of white people in the precincts of Manhattan and Brooklyn where I hang out. If you want to see “life after white people,” better example would be Journal Square here in Jersey City, or Harrison, NJ for that matter. 😂

She can still take action against LaPierre et al. And probably should. One way or another, Wayne needs to go.

And the NRA should still reincorporate in some more gun-friendly state.

And when it does, it’s corporate structure suite be changed to make the board more functional.

If you can say only one thing about the left it is that they use every resource they have to push their agenda.

They don’t expect to succeed with every effort, it is more like the way dripping water can wear away even the most hardest rock.

I grow up in the relatively free America and so can compare to just how many freedoms Americans have lost since then.

The young today have no idea what a freedom is.

The complete lack of accountability of these politicians is stunning. She gets to waste resources without any consequences.

They are both good examples but how many of the whites in Manhattan and Brooklyn live (and pay taxes, and vote) there?

Certainly some, but the number is falling daily. Many of the whites are the same we have in nearby NJ - foreigners (for what that’s worth). White American normals left NYC behind decades ago, and many of the remaining whites are nanny-staters pushing their small children to the front of “vaccination” lines.

The NRA tried to declare bankruptcy in Texas as a way to o get out from under the threat of dissolution. It wasn’t allowed to.

The threat of dissolution is gone. But there are still reasons to leave New York, and reasons to reorganize the board so as to prevent someone from doing what LaPierre did, in the future.

Glad someone finally told her, “Uhh yeah, you can’t do that.” what she was trying to do was the equivalent of a judge shutting down a church, throwing out the parishioners and seizing the building just because the pastor was caught stealing money from the collection plate. Yes, some NRA executives were apparently doing some shady stuff, but you don’t punish an entire organization for the wrongdoings of a few.
