The New Zealand High Court has upheld a challenge to a vaccine mandate for Police and Defence Force staff, stating that it was not a “demonstrably justified” breach of the Bill of Rights.
Justice Francis Cooke was asked by a group of Police and Defence Force personnel to judicially review the vaccine mandate enacted under the COVID-19 Public Health Response Act in December.
The group claimed that “requiring vaccination by such a vaccine was in conflict with the religious beliefs of some of the affected persons.”
Cooke, in a judgment (pdf) released on Friday in New Zealand, did not accept some of the applicants’ arguments but agreed that the mandate “is not a reasonable limit on rights that can be demonstrably justified” and set the order aside.
“I conclude that the Order does not involve a reasonable limit on the applicants’ rights that can be demonstrably justified in a free and democratic society and that it is unlawful,” Cooke said.
“The order limits the right to be free to refuse medical treatment recognised by the New Zealand Bill of Rights Act (including because of its limitation on people’s right to remain employed), and it limits the right to manifest religious beliefs for those who decline to be vaccinated because the vaccine has been tested on cells derived from a human foetus which is contrary to their religious beliefs,” Cooke said.
The mandate required all Defence Force personnel and all Police constables, recruits, and authorized officers to receive two doses of the vaccine by March 1.
But on Jan. 6, three unvaccinated staff who did not wish to receive the shots sought a judicial review of the mandate. They were supported by affidavits from 37 of their colleagues in the same position.

The vaccine is so great that people have to be forced to take it, to protect* against a disease that is so severe that one has to be tested to determine whether one even has it.
*Note that “protection” here means “reduces, but does not eliminate, the probability of a serious outcome”, but it does not mean that it prevent one from catching the disease, nor from spreading it to others, including “vaccinated” others, if caught.

There is absolutely no way to measure or test this statement.
No one has a metric to determine if you got “less sick” from an illness because no one can know how sick you would have bene to begin with.
You can say less deaths but how does one determine how sick anyone would have been?

Neighbor across street told me: XYZ, who I saw occasionally, aged 48 and a health nut. Died in his sleep last week.
My brother in law, 2 days after second jab, in hospital over night, couldn't breath, diagnosed as breathing problem... Last week, in hospital again, this time diagnosed as a stroke. Put on respirator. My sister was told by doctor this is his SECOND stroke- but nobody noticed the first stroke! Most likely, his first stroke was 2 days after his second jab.
Another neighbor's sister (who I know well) had swelling in her left leg. Went to ER, swelling caused by blood clots. Put on blood thinners.
I spent Tuesday taking significant other to ER. Chest pain like someone stabbing her in the heart with a knife. ER said she has NOT had a heart attack. Three months ago, she could keep up with me on fast paced, multi-mile walks. She now complains about being weak walking around in house. She had her "booster" shot in October (against my vigorous recommendations- which she ignored).
So I've only seen one person who I know who has died in their sleep but several others who have had significant negative changes in their health after the jabs.
I think the Fraudci/CCP plan is to deny any problems were caused by the vaxxxxxines even while death rates are increasing significantly.
The Bill Gates eugenics crowd loves the thought of millions dying which will save the planet while the CCP defeats the US without firing a shot.
