Court ruling puts mail-in voting on hold in Pennsylvania

Friday's Commonwealth Court opinion declares Act 77 of 2019 unconstitutional, though an appeal is expected by the Department of State.

A statewide court says Pennsylvania’s expansive two-year-old mail-in voting law is unconstitutional, agreeing with challenges by Republicans who soured on mail-in voting after then-President Donald Trump began baselessly attacking it as rife with fraud in 2020′s campaign.

According to a Commonwealth Court filing released Friday, the court ruled that Act 77, allowing residents to vote by mail in Pennsylvania, violates Article VII, Section 1 of the Pennsylvania constitution. The Commonwealth Court denied the Pa. Department of State acting secretary's application for summary relief.

In the ruling, Commonwealth Court President Judge Mary Hannah Leavitt wrote, "If presented to the people, a constitutional amendment to end Article VII, Section 1 requirement of in-person voting is likely to be adopted. But a constitutional amendment must be presented to the people and adopted into our fundamental law before legislation allowing no-excuse mail-in voting can be 'placed upon our statute books.'" Friday's decision by a five-judge Commonwealth Court panel could be put on hold immediately by an appeal from Gov. Tom Wolf’s administration to the state Supreme Court.

The decision throws the state’s voting laws into doubt in a big election year. The three Republican judges agreed with Republican challengers. The two Democrats on the panel dissented.

NYS under Cuomo instituted “no excuse” mail in for the 2020 election. I wonder if it violated our NYS Constitution.

It was obvious to any person with a lick of commonsense that Act 77 was unconstitutional when it was approved in 2019.

What took the PA court so long to figure out the obvious????

Anyone know the composition of PA’s Supreme Court and what would be the likelihood of upholding the Commonwealth Court if appealed?

I'm aware of one state and one only which runs a fairly decent and trustworthy mail-in ballot operation-- Utah.

And that is because most of the contests are between Conservatives and establishment Republicans.

The Democrats are kind of a fringe party there, like Libertarians. The exception being in one certain large city plus the ultra-rich ski resort areas around Park City.

If all of Pennsylvania does it like our county (Westmoreland County) does, then it is much less of a problem. Here, mail-in ballots must be in by poll closing time or they aren't counted. Then the totals get processed (with full transparency) and reported before any precinct totals are reported.

The only exceptions are a handful of overseas and mail-in ballots which are postmarked by election day and added by the county canvassing board afterward. There are NO 3 am "shazam" mystery morning after ballot drops in Westmoreland County.

It doesn’t even need to violate the constitution, it only needs to contradict the election laws as passed by the legislature to be invalid.

When Republicans first brought suit the PASC said “no one has yet been harmed. Get back to us when they are”.

Then, when the election happened the PASC said LATCHES. Which means “Oh, you took too long to bring suit, so sorry”.

When Trump & many others appealed all the way to SCOTUS they declined to take the case.

The PA legislature got suckered by the Rats. They made a deal with the democrat governor for allowing absentee ballots but then after the mail in ballots were sent, the rats renegade on the deal.

Any election law changes MUST go through two election cycles before it can become legally applicable. This obviously did not happen.

The 2020 Pennsylvania election was ILLEGAL!

Wolf, Shapiro, Fetterman and Boockvar should ALL be in jail.

Mail-in ballots cast by people weary to visit crowded polling places during the height of the pandemic

The word the typist was looking for here was not "weary" but "leery".

In addition to the atrocious misuse of language and grammatical missteps, the article is rife with unsubstantiated editorializing posing as factual content.

I believe it is better to say the GOP controlled PA Legislature colluded with the Rats to pass Act 77.

That’s funny, I’m getting weary of the unsubstantiated rationalizations to promote voter fraud via mail out balloting and I’m leery of our ability to stop the fraud in Blue cities.

I remember this issue. To get mail in ballots allowed is a two-year process, involving a referendum voted on by the people and two legislative sessions.
