Kyle Rittenhouse, the Illinois man acquitted of fatally shooting two men and wounding a third during street protests in Kenosha in 2020, is seeking the return of the gun and other property that police seized after his arrest.
Rittenhouse's attorney Mark Richards filed paperwork with the Kenosha County Circuit Court on Wednesday seeking the return of the items, explaining that Rittenhouse wants the AR-15 style rifle back so that it can be destroyed, the Kenosha News reported.
Law enforcement has had the gun since the day after Rittenhouse shot three men, two of them fatally, on Aug. 25, 2020, during a night of protests and unrest in the southeastern Wisconsin city of Kenosha over the shooting of Jacob Blake, by a police officer.
Rittenhouse turned himself in to police in his then-hometown of Antioch, Illinois, within hours of the shootings. In November, the 19-year-old was found not guilty of all charges related to the shooting deaths of Joseph Rosenbaum and Anthony Huber and the wounding of Gaige Grosskreutz.
Rittenhouse said he went to Kenosha to protect property from rioters and that he acted in self-defense after he came under attack and feared for his life.
Prosecutors portrayed Rittenhouse as a "wannabe soldier" who had gone looking for trouble, while his supporters regarded him as a patriot who took a stand against lawlessness.
The gun was purchased by Dominick Black for Rittenhouse, who was 17 at the time and unable to legally buy a gun and "was to become the legal property of Kyle Rittenhouse upon his 18th birthday," which was Jan. 3, 2021, the motion stated.
Earlier this month, Black pleaded guilty to two citations for contributing to the delinquency of a minor in exchange for prosecutors dropping two felony charges of intent to sell a dangerous weapon to a person younger than 18.
According to court documents, Rittenhouse is also looking to retrieve the ammunition, the sling and the magazine from the firearm, his cellphone, a cloth face mask, the clothing he was wearing the night of the shootings and a $1 bill.
A court hearing on the motion is scheduled for Jan. 28.

Assuming the gun was legal and there were no issues, it should of been returned immediately after his not guilty verdict.
Kyle’s rifle was also evidence in another case, so he didn’t get it back.
They just gotta keep that false narrative going, don’t they?

The officers will be responding to a “shots fired” call or a shooting that occurred during a homicide.
Do not let the word “homicide” panic you; despite most individuals’ use of the word “homicide” to refer to a crime (the “deliberate and unlawful killing of one person by another”), it can also simply mean “the killing of one human being by another.” Either way, the police will likely take your gun as evidence in the investigation of this shooting. Again, do not let the word “evidence” rattle you. As long as you acted in self-defense and were in fear for the loss of innocent life, you’ll likely be able to work with an attorney to vindicate your actions.
Your gun, however, will probably be in police custody longer than you will. Nazir Al-Mujaahid, the first concealed carry permit holder in the state of Wisconsin to use his sidearm in a defensive situation, had to wait almost two years to recover his pistol from the evidence locker even though no charges were ever filed against him.
The state law enforcement agency handling the shooting will understand that if it relinquishes custody of that firearm, the chances of ever getting it back will be very low; thus, the folks there will hang onto it as long as they can on the off-chance they will ever want to assess it again.
The only reason why Dominic Black wasn't charged by the Feds for a straw purchase, and Kyle not charged with conspiracy, is that Kyle never took constructive possession of the rifle that Dominick Black bought.
If Kyle now wants "his" rifle back, that is admission that Dominick Black performed a straw purchase, and Kyle participated in that straw purchase.
Correct. But now that his friend, Dominick Black's case is over, as well, the time is right to ask for a return.
I understand that Rittenhouse might not want the rifle around as a reminder, but I recommend he sell it or give it away quietly in some legally responsible way. Having it destroyed buys into the leftist idea that firearms have some volitional role in what humans choose to do with them. Rittenhouse is responsible for any use of the firearm he finds repugnant. It’s an inanimate object.
Kyle is 18 now. There was never a dispute that Kyle would get possession of the gun when he turned 18. Dominick Black’s family owns a firing range and are familiar with gun laws, so the deal was made so as not to technically violate any laws.
You would probably auction off the shower heads from Auschwitz.
He was found innocent. They’re his. He has a right to get them back.
Imagine having a rifle from a Minuteman from the Battle of Concord that could be traced by a serial number.
Kyle Rittenhouse stepped up when Democrats rioted in U.S. cities as part of their agenda to overthrow We The People.
He’s 19. Don’t they refer to other teenagers as teens?
Let Kyle have the gun. He can go to LA to protect the freight trains.
And if a person was really paranoid after police having held their firearm for an extended period, consider replacing the barrel and extractor.
Never know where evidence could ‘turn up’.
