with all the chaos over testing, and even the validity of tests - PLUS the milder strain of Omicron taking over - it would be insane for this mandate to go forward

I listened to the oral arguments this morning and I did NOT come away feeling they would block the mandate.
Where did you listen to that?
The arguments do not address the fact that those unvaxed by now will NEVER take the jab. For many reasons. Freedom is near and dear to many Americans, we will NOT comply with a senile, decrepit old man’s mandates, ever.

Well, after all, the inmates *are* running the asylum.
I'd be shocked if the OSHA mandate stood. The Medicare/Medicaid mandate may survive, and of course the specific grounds on which the OSHA mandate fails are important as well.
I suspect Roberts will try to persuade the conservatives to issue a narrow ruling if they strike down the OSHA mandate. So maybe strike it down on the grounds that it doesn't qualify as an emergency so it has to go through full notice and comment rather than saying OSHA doesn't have the authority period, or even that Congress can't do it either.
PLUS the fact that Biden said the federal government cannot solve this.....

also said NY healthcare workers will be mandated to get boosters regardless if they have hybrid (vaccine + natural) immunity & with zero evidence of long term benefit.
If you think the worker shortage was bad before, wait until you see what happens with this.

Listened to the oral arguments of the first case (OSHA). Sotomayor, Breyer, and Kagan are definitely with the feds as would be expected. Gorsuch, Alito, and Thomas are definitely going to vote against imo. Have to get 2 out of the 3 left. Barrett, Roberts, Kavanaugh. Its a crap shoot imo.
Sotomayor and Breyer sounded like they got all their info from watching CNN and MSNBC. You would think they were discussing the Plague instead of COVID.

I listened and came away thinking maybe a rejection on a narrow basis. MAYBE. I could also see a 6-3 ruling upholding the mandates based more on fear of court packing than the arguments. That, and Roberts, Kavanaugh and Barrett seem to LOVE big government!
I’ll be thrilled with a 5-4 rejection but I could see a 6-3 ruling either direction....
The 3 super libs were gnashing their teeth and screaming, “We’re all going to die unless Joe Biden saves us!” I almost expected one of them to start attacking the conservatives with a butcher knife.
