Quite right. This preliminary injunction is not a "win" as the article indicates, even if the case is actually successful; at best it can be no more than a "break-even". A win should be marked by a transfer of value to the winner that leaves the winner in a better circumstance than before the contest.

Our political realities are exacerbated by the fact that when we win it is too often simply a blocking event, and the taxpayers have paid for the costs of attempting the offense. In such matters we don't even break even.
