For many rioters who stormed the U.S. Capitol on Jan. 6, self-incriminating messages, photos and videos that they broadcast on social media before, during and after the insurrection are influencing even their criminal sentences.
Earlier this month, U.S. District Judge Amy Jackson read aloud some of Russell Peterson’s posts about the riot before she sentenced the Pennsylvania man to 30 days imprisonment. “Overall I had fun lol,” Peterson posted on Facebook.
The judge told Peterson that his posts made it “extraordinarily difficult” for her to show him leniency.
“The ’lol’ particularly stuck in my craw because, as I hope you’ve come to understand, nothing about January 6th was funny,” Jackson added. “No one locked in a room, cowering under a table for hours, was laughing.”
Among the biggest takeaways so far from the Justice Department’s prosecution of the insurrection is how large a role social media has played, with much of the most damning evidence coming from rioters’ own words and videos.
FBI agents have identified scores of rioters from public posts and records subpoenaed from social media platforms. Prosecutors use the posts to build cases. Judge now are citing defendants’ words and images as factors weighing in favor of tougher sentences.

There was no insurrection. It was a riot.
Who organized the unindicted provocateurs? Why do they remain unindicted?
Jan 6th was horrible because it was the only ‘riot’ in America. Ever.
What we saw on TV all the previous year, in the glow of flaming debris, was simply the exercise of free speech by good folks worried about poverty & justice.
To put it in perspective the “lol guy” will do 30 days more than Smollet or Baldwin or hillary clinton.

The Congress should take their responsibility back to govern the District.
Everyone knows you can tell real insurrectionists by their incessant giggling and funny social media posts. Che Guevara was an amateur, he only executed people.
Hopefully people get wise to all this. We’re seeing people get destroyed for very old FB posts, texts, tweets, and emails. For any kind of messaging, I recommend using an app like Session. It is encrypted, no phone or email required to use, open source, etc. It’s sad we’re in a police state, but it’s the state of things.
People like Amy should *not* be judges. There is nothing impartial about this emotional, biased garbage she spews.
Social media claims another one.
Or,the Capitol cop,whose life was not threatened, that shot Babbitt dead.
When BLM or Antifa declare their intention is to burn down a city or overthrow the government, their actions are described as ‘mostly peaceful ‘ protests by the media, even when they’re burning cars and buildings. Using the words ‘insurrection’ or ‘riot’ are expressly forbidden.
Anti-Kavanaugh protestors did the same thing months earlier. They got removed, arrested perhaps, charges dropped. Media championed them as heroes and was admirable civil disobedience. Amy Shumer was one of the protestors removed from the Capitol.
No charges. No year in jail and put in solitary confinement.
