Ghost guns banned by Los Angeles City Council

The City Council Tuesday unanimously approved an ordinance to prohibit the possession, purchase, sale, receipt and transportation of "ghost guns" in Los Angeles.

The ordinance prohibits the possession, purchase, sale, receipt or transport of a non-serialized unfinished firearm frame or receiver or non- serialized firearm. Such weapons -- known as "ghost guns" because they are virtually untraceable -- can be assembled by unlicensed buyers from legally purchased kits.

By what objective legal criteria does a block of steel with arbitrary shape meet, or not, the legal definition of “ghost gun”?

Whole point is BATFE has stated what constitutes a “firearm”, in a manner by which “80%” is a binary cutoff between is/isn’t a firearm. If it isn’t a firearm, and LA doesn’t otherwise explain, then an “80% receiver” just, well, isn’t a gun - ghost or otherwise.

Basing criminal law on colloquial terminology doesn’t work.

It is generally accepted that building an AR-15 from parts is cheaper than buying an entire rifle from a manufacturer. By banning these firearms they are imposing undue hardship on lower income families. Gosh, if a non-leftist did that, they’d be called racist...

Old aphorism: by ATF rules, a VW Bug is a machine-gun (because it can be converted into one, by a competent & equipped gunsmith, within 8 hours).

Good job, LA, you just criminalized blocks of steel. When does the indictment of Home Depot start?

Yeah, that's a dead letter. There's the whole pesky pre-emption thingy and the BATF definitions and all that other blah, blah in the constitution......but they'll try and enforce it anyway. Because tyrants are gonna tyrant.

Governments regularly do things that are illegal, but the average person (or, company) can’t fight them. A standard tactic is to seize your bank accounts. Then they force you to sign a “contract” to do, or not to do, whatever they want. (That happened to several companies I was dealing with.) That way you can’t sue them because you signed a contract in exchange for certain valuable items. It is then a matter of contract law rather than constitutional law. In the contract, it stipulates you can’t sue them or you’re in breach of contract. It’s hard to turn them down when the creditors are at your door.

Government is like the Mafia, but with a superior retirement plan and good dental coverage.

They are dangerous because every time a gun is fired, the bullet has the serial number of the weapon imprinted on it so the police can trace it to the shooter.

The ATF determines when a particular lump of metal or plastic crosses the 80% threshold and becomes a firearm.

How is the city going to determine if a lump of metal or plastic meets their ‘unfinished Ghost Gun’ criteria if the AFT says it’s not a firearm?

The ordinance was requested by a motion from Councilmen Paul Koretz and Paul Krekorian, which also passed through the council unanimously.

“There’s no question that ghost guns are an epidemic nationwide, but today we have an obligation to protect the lives of Angelenos, and this is one step that we can take to do all that,” Koretz said before the vote Tuesday.

The ordinance prohibits the possession, purchase, sale, receipt or transport of a non-serialized unfinished firearm frame or receiver or non-serialized firearm. Such weapons — known as “ghost guns” because they are virtually untraceable — can be assembled by unlicensed buyers from legally purchased kits. The unfinished parts are inexpensive and not required under federal law to have serial numbers or a background check to purchase. According to the gun control advocacy organization Everytown For Gun Safety, an AR-15 ghost gun kit and lower receiver can be purchased for $345.

Violation of the city ordinance will be punishable by a fine of up to $1,000 and/or up to six months in jail.
