One of the great frustrations with Joe Biden’s vaccination mandate that has led to protests and lawsuits is the provision that puts private-sector workers out of their jobs if they remain unvaccinated. It’s already started happening in some places, but perhaps unsurprisingly, the news hasn’t been all bad for everyone. As most of you know by now, the United States has been caught up in a significant labor shortage this year as businesses around the nation have struggled to reopen. This has led some companies, including job recruiters to take note of a particular provision in the mandate and seek to take advantage of it. The mandate only applies to companies with at least 100 employees. With that in mind, smaller employers that are having trouble finding enough workers have begun actively recruiting the unvaccinated who are either out of work or may soon be because of the mandate. Companies have turned to recruiting unvaccinated workers in the latest effort to combat the nationwide labor shortage that’s holding back companies from bouncing back from the depths of the pandemic.

JP Valadez, a worker at NextGen Code Company in Lubbock, Texas, launched NoVaxMandate.org, an online job board, to help connect the unvaccinated workforce to employers in need of more help, CNN Business reported.

Since the site’s August launch, it’s drawn more than 2.25 million unique visitors and over 20,000 resumes have been posted, Valadez told CNN. The site recently had roughly 500 active listings, the report said.

Others are using the same strategy and smaller individual companies are including those details in their help wanted ads. ‘No vax card? No problem! We are hiring right now!’

I could imagine even vaxed employees would take note of the companies implementing this policy. It speaks to the mindset of their management and how the company treats their employees.
Its sort of like going on a job interview and asking for an extra week of vacation and gaging how they respond.

Why do businesses need a loophole? Thought the 5th circuit ruled the mandate unconstitutional.

There is no such thing a labor shortage only a failure to offer market wages. STOP ARBITRARILY SETTING WAGES. Believe in the free market for wages for Pete's sake.

There are so many “Help Wanted” and “We’re Hiring” signs around the York (PA) area, it’s flabbergasting.

The Fifth Circuit issued a stay while the issue is being considered. That indicates the court thinks those wanting the mandate thrown out may prevail but it isn’t a certainty.

One should understand that many companies like the mandate since they can place the blame on the government but those same companies sometimes prefer their employees are vaccinated.

As you mentioned, a person is crashing his job offer prospects during the interview if he brings up anything regarding vacation (or salary). Dumb thing to do.

However, after a job offer is in hand, it's a legitimate thing to discuss with HR prior to accepting the job. That's when the job seeker has leverage.

I had six or so employers over my career. What worked for me for the vacation thing was to negotiate with HR entering the company with 10 years of seniority for any benefit subject to vesting such as vacation. Later on, I upped this to 15 then 20 years. My last job before retirement, I had 6 weeks vacation the first year.

The rulings of the Federal appellate (”circuit”) courts do not apply nation wide, but only in the states within the court’s jurisdiction.

Ok well from the 5th circuts ruling they concluded:

For these reasons, the petitioners’ motion for a stay pending review is GRANTED. Enforcement of the Occupational Safety and Health Administration’s “COVID-19 Vaccination and Testing; Emergency Temporary Standard” remains STAYED pending adequate judicial review of the petitioners’ underlying motions for a permanent injunction. In addition, IT IS FURTHER ORDERED that OSHA take no steps to implement or enforce the Mandate until further court order.

With the judges saying things like: "...these challenges to OSHA’s unprecedented mandate are virtually certain to succeed."

So yeah, its subject to further court order, but it does not sound like the judges think the mandate can win.

Sure, but the “Biden” junta doesn’t care what the 5th Circuit ruled. They told businesses to ignore that and keep right on implementing the policy, taking people’s private medical information and putting it in a database, hiring enforcers, etc. Companies like mine are obeying the Junta rather than the Court.

I think I said the same thing. Historically, mandatory vaccinations have been the purview of police powers that are reserved to the states. The courts should crush this attempt by the Biden administration to overturn over a hundred years of judicial precedent.

BTW, for the record, while I support the vaccines, I am opposed to vaccine mandates at the federal level. The feds can mandate vaccines for federal employees and military but not for anyone else.

I do believe the feds will prevail on vaccination mandates for the national guard since USSC has ruled that the federal government has plenary powers over the national guard. (Dukakis v. DoD)
