There is a new date for the end of Pennsylvania’s school mask mandate, and it is Dec. 4.
In a follow-up opinion issued Tuesday, Commonwealth Court Judge Christine Fizzano Cannon ordered the end of the mandate effective Dec. 4.
Cannon’s order reversed an earlier stay that would have kept the school masking mandate in place as long as Gov. Tom Wolf’s appeal of the court’s initial Nov. 10 order lifting its mask rule was on appeal to the Pennsylvania Supreme Court.
The appeal is still pending before the high court, but plaintiffs in the case had asked for the automatic stay of the initial order to be lifted in the meantime. Cannon agreed Tuesday, citing the likelihood that the plaintiffs will win on appeal, and her finding that Acting State Health Secretary Alison Beam still has other ways to impose a mask mandate if she believes it is absolutely necessary.
Beam imposed the universal masking order for all students, staff and visitors to Pennsylvania schools after Labor Day weekend out of concern that the new school year would give the coronavirus pandemic a new chance to flourish in schools packed with children, younger than 12, who still weren’t eligible for a vaccine.
It was challenged this fall by a coalition of state lawmakers, private school operators and parents, who argued that Beam had improperly issued the order outside of a pending public health emergency when she acted this summer. Wolf’s public health emergency orders had expired earlier this summer.
In her new order, Cannon said she will lift the current masking order on Dec. 4, with the publication of the next issue of the Pennsylvania Bulletin.
The court’s Nov. 10 decision came two days after Wolf had separately announced that he planned to lift the mask mandate for K-12 schools Jan. 17, calling it “time to prepare for a transition back to a more normal setting.” Wolf said he was making that decision in part because of the recent approval and rollout of vaccines for children age 5-11.

December 4 is better than January 17 but November 17 would have been even better.
I will proudly say the authorities here in my county fought Wolf, and have been fighting him on the powers he wants to weld on the state.
My county’s DA published a letter sent to all law enforcement stating that he would NOT prosecute any violations of Wolf’s mask mandate.
More and more the Biden/Obama Gov. is being pushed back. People are fed up and recognize what the Biden Crime family and this administration is attempting in this country.
