Ten states sue Biden administration over COVID-19 vaccine mandate for U.S. health workers

WASHINGTON, Nov 10 (Reuters) - Ten Republican state attorneys general sued on Wednesday to stop the Biden administration's requirement that millions of U.S. health workers get vaccinated against the coronavirus, saying it would worsen staff shortages. President Joe Biden, a Democrat, said last Thursday he will enforce the mandate starting Jan. 4. The attorneys general of Missouri, Nebraska, Arkansas, Kansas, Iowa, Wyoming, Alaska, South Dakota, North Dakota, and New Hampshire jointly filed a lawsuit in the U.S. District Court for the Eastern District of Missouri in St. Louis. "Placing this additional mandate on healthcare facilities and employees will exacerbate this problem and will likely lead some facilities – particularly those in underserved, rural areas – to close due to an inability to hire sufficient staff," Kansas Attorney General Derek Schmidt said in a statement. The lawsuit said the federal mandate intruded on states' police power and is unlawful under the Administrative Procedures Act because there was no comment period before its release. On Nov. 4, the Centers for Medicare & Medicaid Services (CMS), the regulator for the two federal health programs, issued an interim final rule it said covers over 10 million people and applies to around 76,000 healthcare providers including hospitals, nursing homes, and dialysis centers. An interim final rule is effective immediately without the standard comment period that follows publication. There is a 60-day comment period following its publication, however. Providers that fail to comply with the mandate could lose access to Medicare and Medicaid funds. Medicare serves people 65 and older and the disabled. Medicaid serves the poor. The lawsuit said the CMS rule was heavy handed and did not take local factors and conditions into account. CMS has said there have not been widespread resignations within healthcare providers that have already mandated vaccines.....

I noticed most posts are about the OSHA mandate. This one is about the latest regarding the CMS mandate affecting healthcare workers.

The President didn't have the authority to mandate the masks...so they looked around for a way....Just plain dirty politics.

OSHA created a new rule for this. Really?? How does that work. Next step...OSHA will mandate annual flu shots forever.

The courts will stop this.

Businesses can take care of the matter. For 18 months, large businesses have been picking out cases, quarantining...and it's back to work. To put MILLIONS out of work instead of a few for a couple weeks...is just plain stupid.

Nice language in the ruling shutting it down.

proposed stay would do them irreparable harm. For one, the Mandate threatens to substantially burden the liberty interests of reluctant individual recipients put to a choice between their job(s) and their jab(s). For the individual petitioners, the loss of constitutional freedoms “for even minimal periods of time . . . unquestionably constitutes irreparable injury.”

The massive crowd was protesting against the vaccine mandate introduced by Daniel Andrews which is forcing tens of thousands of people out of work. Andrews is also pushing legislation through parliament which would give him the right to declare a pandemic whenever he wants, effectively making him Dictator for Life.
The people of Victoria do not want any of this and they are making this absolutely clear...

Thanks for posting. I wrote my exemption today. What can’t be done through one mans edict, will be done through his henchmen.. just like Ester, Shadrach, Mesach Abednigo, all the way to the crucify mob. Nothing new. This is an attempt to erase rights of those Created in His image to choose what treatment to receive. Kneel once and never stand again.

Given the smackdown by the 5th Circuit Court to QSHA, I would think the states have a strong case against CMS.

Now, the States probably could mandate the vaxx for their healthcare workers. If the States did that, it would be fun to watch the outcome when New York mandates all healthcare workers get the vaxx and the un-vaxxers move to Texas.

I live in Tennessee, which is deep, deep red, but we keep electing RINOs at every level of government here. The bill they passed in October against the Biden mandate is a toothless tiger with exemptions given to the University of Tennessee and the big Ford plant that wants to build here. There is no one in government fighting for We the People.

Thanks for posting. I wrote my exemption today.

I'm waiting till the last possible moment to write my exemption. For ten years I have worked for a university on a yearly contract. As soon as I get a religious exemption, I will have a target on my back, and I'll be fired by stealth in that my contract will not be renewed. I keep my mouth shut at work about politics, but in the dining hall I have lunch with my colleagues who are all lefties. It's amazing to listen to them talk when they think everyone in their company shares their views. They HATE us. It is visceral hatred. They want us to be PUNISHED with job loss and no unemployment benefits for refusing to take the clot shot.

It should be a clear cut case for SCOTUS to rule the Biden mandate as unconstitutional, but have zero faith in them.

I left a previous job over this with a huge paycut. I trust Jesus. If I am to be targeted, better than others. My philosophy class was taught by a Muslim who stated he would strip all the people in my class of the beliefs of their parents. It was a great exercise in sincere prayer and trust in The Lord. I made an A, earned a place as one who will speak. I would like to say my pushback impacted others. It is not for myself, but Him.
Trust is a difficult thing. He is faithful, even if it doesn’t appear to the world to be so.
I believe I will be fighting for my job, but more importantly for the generations who follow me, thinking they must submit to one mans edict and have his henchmen carry it out.
If we lose every freedom, it will not be because I feared for my own self. It will be for a greater cause.
I have been homeless before. So too, my Lord. It is time.
