The whole point of the over zoomed and processed image the prosecution got admitted was to prove that by pointing his rifle at Ziminski, Kyle provoked Rosenbaum. Kyle aiming his rifle at Ziminski is the core of the "provoked" argument. Now we have clear evidence that that claim is false. I hope there is a way for the defense to use this.

I’m no lawyer, but I’m pretty sure it’s too late. Can’t believe someone didn’t get this to his lawyers — it’s only been ‘lying around’ for over a year.

Should be able to use it for his appeal, though, if guilty. Chances are slimy Binger already has it and kept it hidden.

Binger badgered Kyle over his response, “I did,” when he was accused of pointing a rifle at someone, but that conversation would’ve happened before this new video clip (IIRC).

Based on this video not just blurred and distorted but purposely manipulated and the defense somehow knew it and that’s why they’ve been fighting like hell to have excluded from evidence.

That's my concern. Hopefully Judge Schroeder sees this and realizes Binger suckered him into allowing such sketchy evidence. Exactly as the defense claimed, the over-processed and zoomed image presented false information. Allowing the jury to use that as evidence would be a mistake.

He started making that claim late yesterday and suckered the judge into allowing this in as evidence Kyle pointed the rifle and that is why Rosenberg attacked him

That was the entire point of the pixelated blur the prosecution presented yesterday. They re-argued today that it was Kyle raising and aiming his rifle that provoked Rosenbaum's attack.
