No - the Supremes said so in Texas v White. It'll take an amendment.

I don’t think so. The state was admitted with the provision that it could be divided into as many as five different states if it wanted to. There’s some discussion about whether this is just what any state could do if Congress approves, or if the provision is Congressional “pre-approval” for dividing the state when ever it wants.

That’s what I thought but it may be a myth. There is nothing in the Constitution to forbid it. Texas vs. White was a divided court with politics (not law) ruling the day under Just. Chase. I say TEXIT, here we come!

That got signed away at reconstruction. Ditoo the splitting into five states.

it was part of their agreement to join up... if I remember correctly.

not that the feds would abide by any agreement that limited their power... look what they have done to the US constitution....

No, that's a myth. As is the suggestion that Texas can split into up to five states at will. That may have been true prior to being admitted to the union but once admitted they are governed by the same Constitution as the other states.

No, that’s a myth. Texas can break into 5 separate states if it wishes, though.
