Simple proceedure on all sets would be the prop master and the actor check guns together and both state out loud the weapon is safe. Takes all of two minutes and at the very least saves million$.

They routinely drop charges 6-8 months later in big cities.

Yes, but what reason is there for the Prosecutor to come forward with a "preliminary report"? Are they looking to dupe some participants into providing more information? Hardly. County Prosecutor in Santa Fe County is an elected position.

Criminal vs Civil liability are 2 different things.

Proving Baldwin, as an actor handling a prop gun at the direction of his boss pulled the trigger, is a hard sell for criminal charges for the death, at least not any serious charges.

I never expected him to face serious criminal charges, even if this happened in the reddest of red districts.

He was never going to face manslaughter or murder charges.

Civil court however, he almost certainly will be found to have some culpability, if the victims families sue.

People in the industry know Baldwin is a jerk, and ultimately responsible for pointing at her and cocking a gun he did not check….then pulling the trigger. Twice?

Did the scene call for shooting at the camera?

Be surprised if any of them work with him again.

I hope her family cleans him out .

Yes, sadly there are other people to blame and they will be blamed. Baldwin will get away with negligent homicide with a virtual slap on the wrist. "Contributing factors..." blah blah blah. "No way of knowing..." and "Following established procedures..." yadda yadda.

While someone could make a believable (probably winnable) case for blaming Baldwin and holding him accountable, someone could also make a pretty good case for excusing him. I couldn't, I don't. It is going to come down to the proclivities of the prosecutor. Given as you say the political leanings in the area, we can make a pretty good guess as to how this is going to shake out. Now, if I drive down there and shoot someone negligently...I'm not a lefty. I'd never leave NM again.

All I can say is that even Harvey Weinstein and Jeffrey Epstein, as powerful and connected as they were, wound up behind bars. Baldwin has a past and his luck may have finally run out.

Dave Halls, the Assistant Director, was canned from a gig just a couple of years ago after an accidental discharge. One would think he’d be downright anal about the situation. Go figure.

I’m sorry folks, but I really don’t see politics in this.

Baldwin was never going to face manslaughter or murder charges for this, even in the reddest of red states, he was not likely to face those level of charges.

He’s handed a prop gun, told its safe, and pulled the trigger practicing a scene at the direction of his boss...

Should have have checked it? Sure, but turning that into a manslaughter charge or murder charge is an almost impossible sell.

A series, a long series of mistakes happened well along the road to this.

Think of it this way, your mechanic says he fixed your brakes, you drive your care, the mechanic didn’t fix the brakes properly, you drive down the road, try to break and your car doesn’t stop... you hit and kill someone.... Are you at fault because you didn’t verify the mechanics work before you drove the car?

Civilly, yes Baldwin will face culpability for not checking the gun, if the victims family sues.... almost assuredly, but that’s a fully different standard than criminal culpability.

I don’t see anyone getting a conviction on manslaughter or other lesser murder charges over him failing to check the gun... I just don’t see any DA charging anyone even in the reddest of red districts with murder or manslaughter charges for something like this.

Possibly some lesser charges might go, but the big ones, just don’t see any DA in any district going for it given the circumstances here.

If someone is going to face those sorts of charges, it would be someone else up the chain of custody of the firearm.. the person who’s primary job it is to make sure the gun was safe, clearly didn’t check it and told everyone it was indeed safe.

There is no denying that is their responsibility, and them failing to do so was negligent and lead to the woman’s death.

There may be some other charges they could probably hit Baldwin with, misdemeanor type stuff if they really wanted to charge him with something... but the big ones, murder or manslaughter... no, not given the situation as reported.

You need to go read your link better:

“Involuntary manslaughter consists of manslaughter committed in the commission of an unlawful act”

Failing to check a prop gun, or pulling its trigger while it’s pointed at someone are not “UNLAWFUL ACTS”.

Irresponsible, but not UNLAWFUL.

Baldwin would not be charged with murder or manslaughter in any district based on what has been reported to date.

Politics are a part of every case - the larger the case, the more politics are an integral part. This is true in both criminal and civil cases. Lawyers “frame” their messaging to impact negotiations (where politics is an “invisible hand”) and to impact how a jury will will accept the position of one side over another. Bigger cases use pollsters and focus groups. Santa Fe County is deeply blue. The impact of politics will be both covert and overt.

I see 76% for Biden and 22% for Trump based on the results at the following site:

A nearly 4-1 ratio. Some county seats went uncontested Democrat. I think it’s certainly a landslide!

My point in all this is that even if politics are the determining factor in what happens to Alec, I think the evidence is too strong and his star power too weak. I don’t think he’ll beat this. Criminally nor civilly. We’ll see!

I blame the producer for the lax atmosphere. The producer is Baldwin.

If Baldwin is prosecuted criminally for this it'll be because of his role as Producer. Lots of people don't want to hear this, but normal gun safety in the real world is different than on a movie set. Movies hire professionals, usually two or three per film, to assure that things like this don't happen. The actor's job is to act, not check weapons. If an actor begins fiddling with a firearm the Director would most likely yell cut, and then have the armorer re-check the firearm. Baldwin, however, was a Producer on this project and there are rumors of people leaving because of unsafe conditions. If that's true, Baldwin could very well be charged criminally. Expect A LOT of finger pointing as the heat get turned up.

I'm gonna get ripped for this, but the actor's job is not to check the firearm, the actor's job is to act. Movie productions have VERY STRICT rules regarding firearms in a film, and that's why they have professionals hired or just that. Unless an actor knows something about firearms/ammunition, they'd have no idea if the gun had "live" ammunition or "blanks". I'm not trying to absolve Baldwin of any liability, but it's simply not his responsibility as an actor. However, he was a Producer, and, as such, he he's liable for just about everything and everyone on the set. If there's any evidence that he cut corners, he's toast.
