I was under the impression the assailant’s gunfire while in pursuit of Kyle was established.

I don’t think so. As far as I know the ones chasing him down the street did not fire. Someone, I don’t know if it’s been established who, fired a shot when the pedophile had Kyle cornered at the car lot. There is clearly a muzzle blast visible in the video right before Kyle fired as the pedophile was grabbing Kyle’s rifle.

The initial shot was fired in the air by a guy with a bushy beard. Kyle saw that and started to retreat toward the corner of building. Once he got there the first attacker/Pedo guy jumped out and attempted to grab his gun.
