California Gov. Gavin Newsom, who previously said that Democratic politicians should "lean into" COVID-19 policies such as vaccine mandates and issued the nation's first such mandate for schoolchildren, is trying to get the federal courts to halt a vaccine mandate for prison guards.
Two weeks ago, a federal judge ruled that the COVID-19 vaccine must be mandated for California's prison guards on Eighth Amendment (cruel and unusual punishment) grounds given the risk unvaccinated guards pose to incarcerated individuals. Only 42% of prison guards are fully vaccinated.
The state's prison guard union — a group that donated $1.75 million to Newsom in September's recall election — had argued against the vaccine mandate along with the Newsom administration. Cal Matters reported Wednesday that the Newsom administration has formally moved forward with appealing the judge's order to the Ninth Circuit in an attempt to block the mandate.
Newsom's hostility towards the mandate for prison guards does not align with his previous statements on COVID mitigation efforts, including vaccine mandates.
*** The governor has also faced criticism for not mandating the COVID-19 vaccine for school staff in addition to children. Teachers unions were also large donors to Newsom's anti-recall campaign.
Because of the inconsistencies, Newsom has been lit up in recent weeks by normally friendly newspaper editorial boards.
"What’s keeping Newsom from requiring that staff members must be vaccinated by, say, Dec. 1, since the FDA has already cleared the vaccines for adults?" reads an editorial from Bay Area News Group. "Or students 16-and-older, for that matter, since they, too, have the FDA’s stamp of approval."

Newsom’s chronic abuse of power and status is emblematic of the grim future awaiting all who live under single party rule.
The ruled will have to choose whether to live in the misery of knowing that their rulers exercise unrestrained lawlessness, or to embrace the glittering celebrity of the rulers as though they are more than mere mortals.

Prison guards are a big political power in Cali.
Payoff for their support.
That’s the issue to push in lawsuits. The unequal treatment of the mandate enforcement. If it is not mandated for school staff but is mandated for students, especially since kids are less likely to get/pass on the virus, then there should be no mandate for sports events, bars, restaurants etc. It has to be enforced equally. That is the issue that finally won the church restriction cases.
