Appeals court rejects Texas' request for an order to stop SAISD vaccine mandate

The Fourth Court of Appeals has rejected Texas’ appeal of last week’s ruling by a judge in Bexar County who refused to stop the coronavirus vaccination mandate for employees of the San Antonio Independent School District.

The decision was issued late Tuesday and the state is expected to appeal it to the Texas Supreme Court.

The deadline for the district’s 7,000 employees to be vaccinated is Oct. 15.

Gov Abbott issues EO to prohibit vaccine mandate for all public employees. One School District in the entire state of Texas decides to thumb their nose at state law. Two county judges uphold the vaccine mandate for all SAISD employees with a deadline to submit vaccination status by Oct 15. Trial is set for Jan 19, 2022. However SAISD HR continues to threaten termination unimpeded, knowing that employees have no protection from the state until Jan 19, 2022. This looks VERY bad. If SAISD can get away with this, what other public entities with radicalized HR organizations will feel emboldened to ignore state law? Abbot and Paxton crushed mask mandates but get their behinds handed to them over a much more serious matter involving medical choice and freedom over decisions related to peoples bodies?

Meanwhile, 197 fully vaccinated San Antonio ISD employees infected with Covid in August. 70% of all 285 cases for August.

I honestly hope that Paxton does have a plan, but the clock is running out. Oct 15 is fast approaching.
I can say 1st hand that many employees never thought the district had a chance to succeed with this mandate.
It was initiated by the former superintendent who was gunning for the Chicago ISD Superintendent Job. Well, he most definitely made a name for himself with this insane mandate and the Chicago ISD hired him. He took the Chicago job and quit San Antonio about a week ago.
So, Pedro Martinez promotes himself with a big bold vaccine mandate to sharpen up his resume, leaves the district, and now the district employees are stuck with a vaccine mandate that the State can’t seem to reign in.

On the plus side - it sets a precedent for anti-vax mandates for counties in blue states.

So if the Texas AG fails to obtain an emergency injunction before Oct 15, you’r saying that school districts in blue states will feel emboldened to implement vaccine mandates ?

Those left wing states are already mandating this insanity. I’m concerned about the state of Texas.

They should file for an immediate injunction.

They have valid reason, since there is no remedy under law, and the consequences are immediate.

The 4th COA is dominated by Democrats. Lori I. Valenzuela is the only Republican on the court.

This will be appealed to the Texas Supreme Court. I suspect that they will issue an injunction, just like they did the last time a COA went rogue.

As far as time for the Texas Supreme Court to act is concerned, I’ve been involved in several ground breaking issues with the Texas Supreme Court over half a century. They can move/act tonight if they want to.

Patience. The case hasn’t reached the Texas Supreme Court yet. They lost in the Fourth (San Antonio) Court of Appeals on mask mandates, too, before the Texas Supreme Court granted a stay a couple weeks ago.

I am very concerned. Three member of my family would be fired over this mandate. Texas is still short teachers for this year wihout this stupidity reducing the numbers.

I just sent this story to Gateway Pundit. Would love to also get it to Kane at Citizen free press, but do not know if Kane allows news tips.

Enough of the right type of media exposure could possibly help with an emergency injunction in case AG Paxton is not planning any further strategy or legal tactics between now and this Friday.
