Federal judge issues order blocking Texas' 6-week abortion ban

(CNN)A federal judge in Texas issued an order Wednesday blocking the state's six-week abortion ban. US District Judge Robert Pitman's order is a victory for abortion rights proponents, who had seen other attempts to block the law stymied by the ban's novel design. It may, however, be only a temporary victory. At a hearing Friday, a lawyer from the Texas attorney general's office made clear that the state would appeal such an order to the 5th US Circuit Court of Appeals if it were granted.

That appeals court -- perhaps the most conservative in the country -- previously rejected a request from clinics that it block the law, as did the US Supreme Court.

Here’s the compromise I propose we offer the pro-choicers: We are for your right to choose to abort your pregnancy, so long as the abortion does not harm in any way the life or health of the baby.

Well, if the current Obama/Biden white hut can blow off the SCOTUS, which they are also doing against the law and with impunity, i would side with blowing off the fraudulent and treasonous dimentia Buyden puppet to defend what is actually moral and godly, and lawful and right.

These little people are our most beautiful and innocent blessings and citizens, and should be fully protected by the highest law of our land.

Exactly. The executive branch and legislative branches simply ignore the Constitution and federal law at their convenience.

So, Texas should tell that judge, “nice opinion. Come enforce it.”

Since the U.S. Supreme Court refused to hear the initial case and block the enforcement there was no ruling. This set up exactly what happened a lower court issued a ruling which will now be appealed to the next highest court the 5th circuit who will have to choose to hear the case or refused and let the lower court ruling stand. If they hear it and sustain the ruling Texas can then and only then appeal it to the USSC who again has the choice to give standing and hear the case on merits or refused to hear the case and again let the lower court ruling stand. There is no way to force the USSC to hear a case and issue a ruling they have complete control over that process.

"In a 113-page opinion, U.S. District Judge Robert Pitman took Texas to task over the law, saying Republican lawmakers had “contrived an unprecedented and transparent statutory scheme” by leaving enforcement solely in the hands of private citizens, who are entitled to collect $10,000 in damages if they bring successful lawsuits against abortion providers who violate the restrictions.

The law, signed by Republican Gov. Greg Abbott in May, prohibits abortions once cardiac activity is detected, which is usually around six weeks, before some women even know they are pregnant.

“From the moment S.B. 8 went into effect, women have been unlawfully prevented from exercising control over their lives in ways that are protected by the Constitution,” wrote Pitman, who was appointed to the bench by former President Barack Obama.

“That other courts may find a way to avoid this conclusion is theirs to decide; this Court will not sanction one more day of this offensive deprivation of such an important right.”

Pitman's gay butthurt over having waited forever to get a Federal bench; knowing he will be overturned by the 5th; and further, knowing he will never be elevated to the 5th.

All this pillow-biter has done is hand the 5th a case to block cert. SCHADENFREUDE!

"Pitman's order blocks any officer of the state -- including state court judges and court clerks -- from enforcing the ban. He explicitly prohibits those officers from "accepting or docketing, maintaining, hearing, resolving, awarding damages in, enforcing judgments in, enforcing any administrative penalties in, and administering any lawsuit" brought under the state law.

The judge also ordered the state to take proactive steps to inform court officials, as well as private individuals seeking to enforce the ban, that the law is currently blocked under his order. Because government officials aren't tasked with implementing the law, Texas argues that there is no one that a court can preemptively enjoin, the way the courts would preemptively enjoin officials from implementing the usual types of abortion restrictions that impose criminal or administrative punishments.

At a court hearing in the case Friday, an attorney for the state said he could not identify a person that could be targeted by a court in an Order blocking the law."

Legislator in robes, and weak sauce at that. His Order is going down in flames, how apropos that it was issued by a flamer, a fellow down-low traveler like his master Obama.

I expected this to happened eventually. The sooner the better, actually. This moves it more quickly to a final resolution at the Supreme Court.
