Biden teases new eviction freeze, admits likely unconstitutional

President Biden said Tuesday the Centers for Disease Control and Prevention would announce a new moratorium on evictions later in the day — before admitting that its order was “not likely to pass constitutional muster.”

The New York Times reported earlier Tuesday that the new freeze would likely be in effect for up to 60 days and apply to places with high rates of coronavirus infection.

A previous nationwide eviction freeze expired on Saturday after congressional Democrats failed to garner enough support for an extension before House members left DC to begin their August recess.

The White House had urged Congress to pass legislation extending the moratorium after the Supreme Court decided in June that the CDC overstepped its authority by enacting the ban. The court left the moratorium in place through July 31 in a 5-4 ruling but one of the five, Justice Brett Kavanaugh, warned that extending the freeze beyond that date would require legislation from Congress.

“I’ve sought out constitutional scholars to determine, what is the best possibility that would come from executive action or the CDC’s judgment? What could they do that is most likely to pass muster, constitutionally?” Biden told reporters at the White House Tuesday.

“The bulk of the constitutional scholarship says it’s not likely to pass constitutional muster … But there are several key scholars who think that it may, and it’s worth the effort.”

House Speaker Nancy Pelosi (D-Calif.) said in a statement Tuesday that Democrats “stand ready” to work with the White House to find a way to extend the ban.

To Biden, unconstitutionality is a FEATURE, not a PROBLEM.

He’ll put the ban in place, knowing full well it could be months or even a year before SCOTUS strikes it down.

IF it strikes it down.

I love the way these MFers can just point at a certain group of people - landlords for now - and decree they foot the bill for the pandemic.

No law making, no representative government, just some unelected s**tbag at the CDC says that everyone in America can just stop paying rent - for any reason whatsoever. What country is this?

They are going to tie it to a 5 trillion dollar pork package so they can blame the republicans for not voting for the pork package which contains a few dollars for “eviction” relief.

It’s not a ban or a moratorium. It’s an illegal action by government. It is invalidating the terms of a valid contract.

The public has been sheepified and is too stupid to know it.

It takes a joint effort of Congress and the Executive to overturn a Scotus ruling

They don’t have congress, therefore it’s unconstitutional agency action and nobody has to follow it

This is the most transparent phony-baloney "concern" I've ever seen in American presidential politics. The Supreme Court ruling that said the then-current CDC moratorium till July 31 could stand but anything beyond that without new legislation would be unconstitutional was made in June, and it wasn't until like July 30, literally the day before its expiration, that Biden and Pelosi suddenly spoke about having Congress pass a new law. They spent the entire time of over a month instead focusing on infrastructure. They don't care about this, it's pure last-minute grandstanding to make it feel like they care to the most gullible of Americans.
