I can understand an employee filing suit if the employer prohibited masks but what if the employer allowed/encouraged the employee to wear masks.
Of course, an employee could sue if the employer allowed unmasked persons to enter the facility and the employee became infected.
This is really a problem caused by not allowing the employer to police who enters by requiring proof of vaccination. If the employer merely posts a sign that unvaccinated must wear a mask, you know that many unvaccinated will ignore the sign and enter without a mask anyway. The employer really doesn’t have a good option except mandate masks.

Large employers probably need to get expert scientific advice.
