A federal appeals court, which previously sided with the Centers for Disease Control and Prevention (CDC) amid Gov. Ron DeSantis’s (R-FL) battle against the federal health agency over the vaccination rules it is imposing on the cruise industry, reversed its decision, ultimately siding with the state over the CDC’s No-Sail Orders.
On Friday, Florida “filed an Emergency Application to Vacate the Eleventh Circuit’s Stay on the Preliminary Injunction.” That same day, the Eleventh Circuit reversed its earlier decision, allowing the cruise industry to resume operations without adhering to the CDC’s restrictions, including what effectively amounts to vaccine passports, which are illegal in the Sunshine State:
The panel sua sponte VACATES its order of July 17, 2021, and substitutes the following order in its place:
The appellants’ “Team Sesitive Motion for Stay Pending Appeal and Administrative Stay” is DENIED because appellants failed to demonstrate an entitlement to a stay pending appeal. See Nken v. Holder, 556 U.S. 418, 434 (2009).
There are four factors a court considers under the Nken standard. One is if the appellants have a substantial likelihood of ultimately winning on the merits. The appellate court’s reversing course suggests that upon further review, even this liberal panel decided that DeSantis is right on the law here.

Vaccine Passports are Fake News because they don’t include the naturally immunized population, the survivors of CoVID, who now have Natural Immunity. Pity the poor fools who believe this ‘vaccination’ propaganda and were immune already but took the ‘jab’ unknowingly. But they would qualify for the Immunity Passport as well.
And what will our lovely Supreme Court with its “Conservative” majority have to say in the end?
Doesn’t really matter. DeSantis may tell the cruise lines that they have to let unvaccinated people onboard but once onboard cruise lines like Royal Caribbean are placing all sorts of restrictions on unvaccinated passengers. The DeSantis order can’t change that.
While it’s true the SC are a bunch of cowards, in this case it means they may simply decline to hear further appeala in which case the State of Florida’s win will stand.
All:
Let’s take the win. We need more, yes, but take the win.

The whole point is they won’t know who is vaccinated.
Sure they will. Those who can prove vaccination by showing their vaccination card will have the run of the ship. Those who can't show the card will be considered to be unvaccinated and will be restricted. Easy peasy.

The whole point of the lawsuit was that Florida passed a ban on vaccine passports, which means it’s against the law to ask for proof of vaccination. That was the law that was just upheld.
So, It’s not against the law to ask if you are vaccinated, but it is against the law to ask for proof. We are basically on the honor system.
Their boat, their rules. The law may say they have to let unvaccinated onboard but it doesn't mean they have to let you have the run of the ship.
