Originally the Senate members were picked by state legislatures but the 17th Amendment gave that power to the popular vote. I wonder if that was a huge mistake as it allowed state governments that are primarily one party to have Senators that are from the other party.
The minute that they try to force any member of congress to testify they run into the speech and debate clause of the constitution. I would expect the congressmen/women/senators subpoenaed to vigorously fight it through the court.
The 17th pulled the keystone from the Framers’ unique republican form. The Constitution acts on the states. Simple republican theory demands their presence at the legislative table.
It is tyranny for congress to pass laws affecting the states when do not have representation.
