Captured on surveillance video waving a Donald Trump flag near the dais of the U.S. Senate Chamber on Jan. 6th, Florida man Paul Hodgkins received an 8-month prison term on Monday. Hodgkins is the first person on the U.S. Capitol breach docket to be sentenced for committing a felony, and prosecutors argued a stiff sentence was necessary to keep others from engaging in acts of “domestic terrorism.”

First plea deal for someone charged with a felony. Defense attorney wanted home arrest, prosecution wanted a year and a half, he got 8 months.

Did not see it mentioned in the article, but he should be getting credit for time already served. If he is one of those who has been held in jail w/o bail, he may have 5 or 6 months worth of credit, depending on when he was arrested.

Does anyone know if he is getting that time served credit?

Obstruction of an Official Proceeding and Aiding and Abetting. Pled guilty to that and the other charges were dropped.

That is the federal standard. I’m not sure if judge’s are bound by that standard by statute or rule or if they can deviate from it at their discretion. I’ve never seen a case where time-served wasn’t credited in federal court.

Time served should cover most of that sentence.

Kevin Clinesmith lied under penalty of perjury in order to violate the civil rights of a citizen - a citizen he knew to be innocent and in fact, an intelligence asset. For that, he didn’t even spend the night in federal custody.

Some morons parade through the halls of Congress taking pictures and whatnot and they get prosecuted for felony trespassing.
