The state legislatures may have requested that the suspect votes be returned to them, but that was not really necessary for Pence to return them.
They had been returned to the states 11 times in the past, usually by Democrats when a Republican had won.
Pence waited till January 5 to tell Trump he was not going to exercise his option to return the votes and stop the certification.

On War Room just now, John Eastman said that two (maybe three) states requested that. Pence ignored that.
A state rep or state senator asking Mike Pence to do something is NOT “a state requesting it”.
Clearly, minority (rump) caucuses in Michigan and Pennsylvania asked for Congress to reject their state’s EVs. Yes that did happen.
But no State Legislature passed a resolution disavowing their state’s Electors and requesting that those EVs not be counted. This did not even come CLOSE to happening.

I agree that a sitting Legislature can appoint Electors however it pleases, and I further agree that, prior to December 14, the Legislatures of AZ, WI, MI, PA, and GA could have done exactly that.
But they didn’t. Congress has Article I authority to “fix the date on which their votes shall be cast”, which in this case was December 14, 2020.
After that, the Legislatures which declined to act have no further role. It is impossible for me to imagine a body or tribunal which could say otherwise.
