Stupid if true, and part pipe device...

Having pieces of pipe and end caps is enough for them to allege you had "parts" for a pipe bomb.

This is the FBI who works for the Politburo.

unless the pending charges, which i didn’t see cited, were less than what the NICS form calls out.

If one of the conditions was to turn in all your guns, would
you be quick to comply?

It was a small section of pipe capped on one end and a fuse on the other. Just add explosive. He will likely go to jail for it.

Source?

Also, why would anyone put a cap on one end and a fuse on the other before adding explosive? Wouldn't you leave one end of the pipe open so that you could fill it with explosive?

I am not saying it did not happen. There are clearly a lot of dumbasses out there.

18 USC 922(n) States:

(n) It shall be unlawful for any person who is under indictment for a crime punishable by imprisonment for a term exceeding one year to ship or transport in interstate or foreign commerce any firearm or ammunition or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.

It says nothing about divesting any currently owned firearms, and it specifically prohibits him from shipping or transporting any firearm while under indictment.

If he cannot transport the firearms, how is he supposed to divest himself of them? Call in the "Gun Moving Company?"

Partially loaded pipe bomb is the the same as a fully assembled lego Capitol bld. It means he had pipes in his walls and a box of black powder for ammo reloading in his gun safe.

"...arrested and charged in connection to the January 6 insurrection so far."

Has anybody actually been charged with "insurrection"?

After further information posted by other FReepers above, it appears that he bought the guns online and had them shipped to his FFL, but he has not taken possession, filled out a 4473, or had a NICS check.

The government actually outright lied about that “pipe bomb” and they did it in a sanctionable manner.

In their motion, the government tried to paint the object that was found as a bomb. They left out that it was found in a box labeled “Alerrt kit, props.” Alerrt is an acronym for a national law enforcement training program where officers are instructed in how to respond to active shooters. The officer here is an Alerrt instructor and had the “bomb” as a prop.

The FIB actually left it behind when they did their search warrant.

Then the two U.S. Attorneys who filed the motion to revoke the bond lied about what the item actually was.

The government also neglected to mention that the “loaded M4” belonged to the officer’s son and the officer wasn’t home at the time and never had possession of it.

The two U.S. attorneys would be sanctioned and brought up on ethics complaints in a still functioning system.

It was as blatant an attempt to mislead the court as I’ve ever seen.

If he has a plumbing pipe, maybe a pipe cap, and black powder for his “E-e-vil” Hawken 50 cal rifle, then he has the makings for a pipe bomb.
Any home in the US has the makings for such devices as ends and pieces are everywhere, and every hardware store has pipe nipples in various sizes.

Remember a few years back when the 50 cal rifle suddenly became the next target to be banned? Some reporters got a thrill when they found several 50 cal Hawken muzzle loading rifles on a gun store and tried to make an issue of it.

If you go back to the original CraPo article it lays out the story fairly well

That article does provide a lot more facts, but it still is not clear that he purchased any firearms after January 6.

They do not say when he bought them online, just that he is accused of “transporting them in interstate commerce while under felony indictment.” That could simply mean that he ordered them before January 6 and that they were shipped from the manufacturer to the dealer after January 6. Yeah, I am parsing words, but so are the FBI and the media.

He clearly screwed up by not turning over all of his firearms to someone else to hold immediately after he was released. The first time the FBI searched his house and found 8 firearms was only two days after the court's deadline to turn over possession of his firearms to someone else. That could be excused as simply being slow or a dumbass. Apparently, that is how the judge construed it, because the judge gave him "a second chance, reminding him of his release conditions."

When he still had possession of an M4 Carbine last month it was a clear violation of the release conditions. If he also had an actual partially assembled pipe bomb (and not just plumbing parts) and he purchased 34 guns after he was released, then he is toast.

I am still unconvinced on those points. It could simply be the FBI bolstering the allegations against him (GASP, I'm shocked, shocked I tell you) or it could be that he is a genuine dangerous dumbass that needs to be locked up.

Thanks! Interesting read, and certainly less dramatic than the government’s version.

No, I am correct. The court filing just explains the "why". And he claims the gun is his son's. That does not mean he won't be charged. I made stupid stuff like this when I was a kid.

Note that the label on the kit says "props" and "sims", and he used these props as an instructor. That won't stop the feds from charging him with manufacturing and possessing a "destructive device". They will probably use this to coerce a guilty plea on a lesser charge. That's how they normally work.

What exactly are you betting on, that he will be charged? That he will make a plea deal? Why would I bet on something like that? With a few exceptions, I want all those being harassed over Jan 6th to be left the hell alone.

That he won’t be convicted of having an Alerrt prop.
