Pornhub asked a Birmingham federal judge on Wednesday to dismiss a lawsuit brought by an Alabama teen who claims she was raped and that the incident was posted to the adult website, claiming the company is immune to liability for what third parties post to the platform.
MindGeek, Pornhub’s parent company, said it was entitled to so-called Section 230 immunity, which it said gives Internet companies “broad immunity from liability for content posted to its websites by third parties.”

Pornhub is as slimy organization but if they are truly a neutral platform, are not a “publisher”, do not filter the posts of others who post on their site then their claim may stand, 230 may stand.
A win for them would be bad news for the likes of Facebook and Twitter who clearly “publish”. We can deal with Pornhub later!

I also believe Trump’s lawyers should use this case against Facebook, Twitter, Google, etc. Make it a case against Pornhub.
Why should Facebook, Twitter, and Google be given immunity not given to Pornhub? Trump’s lawyers should compare/equate their 230 immunity to that of Pornhub. Make them have to defend Pornhub’s position. It won’t go over so well with most people.

For porn, I think that would be especially important as it is not always clear what is fantasy or reality.

Their argument for Section 230 protection is as legitimate/illegitimate as any other.
The Law needs to be changed. This is just an over-the-top, and truly awful case to do it.
People who advocate for the repeal of 230 haven't thought this through. Without it, any time a commenter here said something defamatory about anyone, the operator of this site - be it a corporation or person depending on its ownership framework - would be exposed to defamation litigation.

In any event, I believe this case predates PornHub’s ‘new’ policies which they famously implemented sometime last year, purging hundreds of thousands of videos submitted to the site ‘anonymously.’ It’s hard to believe that was allowed from the beginning. It was an invitation for criminal behavior to flourish.
To upload now requires a ‘verified’ account. I have no idea how verified those accounts really are or if they have someway of documenting the age of the ‘actors.’ If they don’t, that seems like an enormous loophole that either Congress and/or the states should close, immediately.
I’m also not sure where Pornhub’s servers are located. If it’s outside the US, it may be harder to regulate without banning the domain altogether.
