The three remaining contenders in New York City’s Democratic mayoral primary have all filed lawsuits demanding a potential recount of the June 22 ranked-choice election vote, the winner of which has still not been determined.
“It is without precedent in a New York City mayoral race or any citywide office,” said election attorney Stanley Schlein, who represents former Sanitation Commissioner Kathryn Garcia in her legal action against the NYC Board of Elections (BOE).
Civil-rights lawyer Maya Wiley sued Thursday in Brooklyn state court requesting that all the ballots that were “cast or attempted to be cast” be preserved for a possible review.
“This is a wide open race and as is standard procedure, my campaign filed a petition to preserve the right to challenge the results should we believe it is necessary,” Wiley said in a statement Friday.
Brooklyn Borough president and former police captain Eric Adams, who still leads the Democratic-primary contest, filed a similar suit Wednesday. Adams outpaces Garcia by just over two percentage points, amounting to 14,755 votes, as of the latest ranked-choice ballot drop, but there are many absentee ballots still outstanding and waiting to be counted.
The candidate lawsuits come after the NYC BOE admitted to erroneously updating vote totals by accidentally adding 135,000 test ballots.
The BOE released its statement after the candidates’ campaigns noticed a sudden surge in the vote total of 100,000 plus, shrinking Adams winning margin significantly. Before the BOE published an explanation for its blunder, Adams questioned the “discrepancies” and “irregularities” in the results after losing ground.
Adams objected to the original introduction of the ranked-choice system for the NYC mayoral election, arguing that it would complicate the voting process and disenfranchise minority voters.

New York City has 3.7 million registered Democrats, 1.08 million Independents, and about 566,000 Republicans as of February 2021.
Hence the cesspool that is NYC.

The dirty secret is that Dems CANNOT have a black person running a giant city ever again.

But THIS recount is for the right and valid reasons - just ask any liberal.

I have a very streamlined thought process:
If the left wants to change something relating to elections, it is bad. It is to rejected out of hand.
With the Left, they want to gain the electoral advantage by attacking the integrity of the process on many fronts to tilt the table overall in their favor no matter the issues at hand. They know they cannot do it with their policies because there is no mandate for their policies. Who wants to pay higher taxes? That kind of thing. So they attack the electoral process on all fronts.
So they try to do it via changing the electoral process. Just look at everything they propose or reject:
They are attacking this on many fronts, and I believe they are succeeding. Things like The Secretary of State Project, ballot harvesting and ranked voting seem pretty innocuous, but they will eventually have large impacts.
We need to fight these traitors tooth and nail.
Yup! I know I’d be filing suit for an actual recount, but maybe the author knows something we don’t.
Going back to the dumb voting machines is not the answer.

Yes sir, they declared Adams the winner of AZ 2024 presidential election. Figured they get that out of the way early.
Maybe I’m not clear on how rank choice voting works, but it seems to me that they have to count all the ballots first (including each and every absentee ballot) before they can move to the ranking process. Otherwise, they won’t know who is actually in last place, next-to-last, etc.
And, as I understand it, they have to start the ranking by reassigning the 2nd, 3rd, 4th, and 5th place choices of those voters whose candidate came in last. If you don’t know who that is (because all the votes have yet to be counted), how do you proceed with ranking, as they have done?
Are they that dense, or am I missing something?
