You may be correct. We don’t know. Why aren’t the defense attorneys and Congress demanding the DOJ and courts comply with the Constitution’s right to due process and a speedy trial. Let’s start the trials in July and give prosecutors the opportunity to present evidence of crimes for each of the accused “rioters”. If most of the people in the Capitol were actually let in by the police and just walking through the building peacefully, the government will have no video evidence of any crime other than potentially trespassing. If there is other evidence, the government will have to present it and witnesses under oath to attest to the crime. Likely trials will quickly dispense of 80-90% of the cases it will be shown most of the so called “rioters” were not involved in rioting or property destruction.
That leaves perhaps 50-100 individuals who may or may not have been involved in property destruction and physical violence against Capitol Police. The evidence will have to be on video or actual testimony. If actual crimes were committed, the identities and backgrounds of the criminals will become public information. We will then know if they were really Trump supporters, Antifa, paid agitators, or perhaps even FBI undercover agents. We will also know if the actual violence was the work of a few dozen people or a mob of “hundreds”.
Defense attorneys by now should have access to the video evidence in the hands of the government. If they don’t the attorneys should be in court demanding dismissal of the cases or the evidence turned over to the defense.
The curious thing is why the defense attorneys acquiescing to the denial of Constitutional rights to due process? Why aren’t they in the appeals courts loudly demanding justice? Why aren’t they demanding release of government records? Are the defense attorneys compromised? One might suspect there is tremendous pressure on them from activist groups and other attorneys to permit a slow unconstitutional process to grind on indefinitely.
The current status, where no people are imprisoned without bond and court dates, only serves to preserve the narrative of Cuomo and the mainstream press. Actual trials will force the truth to come out. However, without extreme pressure from the attorneys, conservative groups, and Republicans in Congress, the accused will in order to gain relief from the current state of legal limbo and incarceration.
