McCloskey’s Beat Rap, Claim Victory in Plea Deal with Anti-gun Prosecutor

Almost a year ago, on 28 June 2020, a mob of loud, screaming BLM protestors in St. Louis, Missouri, followed the agitators/leaders into private property through a locked gate.

Reacting to the threats, Mark and Patricia McCloskey grabbed two firearms, an AR-15 type rifle, and an inoperable Bryco semi-automatic pistol. The McCloskeys seemed fully justified under Missouri law. The state Attorney General defended them in public. The Governor said he would pardon them if they were prosecuted.

This did not deter radical St. Louis Circuit Attorney (prosecutor) Kim Gardner. She insisted on prosecuting the McCloskeys. Eventually, she was removed from the case for conflict of interest.  Gardner appealed the decision, lost the appeal, then appealed the Missouri Supreme Court, which decided not to hear the case.

Richard C. Callahan was appointed as the special prosecutor to take the place of Kim Gardner. An unbiased special prosecutor would have dropped all charges. Callahan was not unbiased.

Special Prosecutor Callahan had spent 30 years as a St. Louis prosecutor. He had been appointed by President Barack Obama as the U.S. Attorney for the Eastern District of Missouri, in 2010.  Callahan is reported to be a longtime ally of former Senator Claire McCaskill (D) Missouri.  Callahan is a lifelong Democrat.

Some of the statements made by Prosecutor Callahan, after the plea deal was agreed to, were telling. From ksdk.com:

Getting a conviction on the felony charge would make it subject to all of the gun laws that favor self defense in Missouri.

For those of you who think the McCloskeys sold out their principals by accepting a plea deal that included no jail time, and no felony conviction that precludes their Second Amendment rights, I ask if you are willing to pay their six-figure legal bill that would have been incurred had they decided to go to trial.

Agree with both of you. What should happen now, is Gov. Parson should pardon even this misdemeanor to repudiate this Soro-ite St. Louis DA. MO folks should contact him about this.

Defending your house from a known-violent mob using firearms is about as American as it gets. Even this misdemeanor plea deal is a travesty of justice.

The McCloskeys had the choice to be right or dead right. They correctly chose to be right; sometimes being dead right comes at the cost of also being dead, so to speak.

Yep - they had to give the prosecutor some kind of small bone to let them save face. A reasonable end to a well-played negotiation.

I agree, a complete travesty of justice. I don’t know exactly how the MO constitution enumerates the Executive’s pardon power. There’s a chance the governor cannot pardon someone who hasn’t been convicted of anything as the US president can do.

BUT, if he does in fact enjoy a pardon power that is effectively identical to the President’s, then there’s no excuse that he didn’t pardon them months ago.

Yes. She was taken off the case because of a conflict of interest.

Instead a lifelong Democrat hack was put in a prosecutor.

He said the most important thing in the case was having the guns forfeited and destroyed.

Absolutely. I did some research on that when this event went down on the Missouri campaign disclosure site. She got several hundred thousand of in kind media buy contributions from a Soros outfit in DC.
