The Department of Justice (DOJ) on Thursday filed court documents saying recently passed laws in Arkansas and West Virginia restricting transgender rights are unconstitutional.
The legal briefs, shared on Twitter by The Huffington Post, argue that the state laws violate the Equal Protection Clause of the Constitution’s 14th Amendment.
The DOJ called the Arkansas law "dangerous governmental intrusion." One of the provisions in the state law prevents doctors from performing gender reassignment surgeries.
"Rather than rely on the judgment of medical professionals and evidence-based treatment guidelines, Arkansas has inserted itself within one of the most confidential and personal of relationships: the physician-patient relationship," the DOJ wrote.
The DOJ went on to say that under the 2010 Affordable Care Act, individuals have the right to nondiscriminatory access to health care.
The Affordable Care Act, commonly referred to as ObamaCare, was upheld by the Supreme Court on Thursday in a 7-2 ruling.
The Arkansas bill was vetoed by Gov. Asa Hutchinson (R) in April, but the state legislature voted to override his veto and enact the measure.
The DOJ took a similarly harsh tone in its court filing against West Virginia's law regarding transgender girls participating in youth sports.
"The United States has a significant interest in ensuring that all students, including students who are transgender, can participate in an educational environment free of unlawful discrimination," the brief states. "This includes ensuring that recipients offer equal athletic opportunities to students regardless of their sex."
The DOJ said West Virginia's law violates both the Equal Protection Clause and Title IX.
Gov. Jim Justice (R) signed West Virginia's measure into law in April.
These mutilations are not “health care.” Even if greedy doctors have found a way to make money off of them.
Headline is lie. There is no ban in “transgender youth”.
Boys can play on boy teams.
Boys cannot play on girl teams.
How would they know that? It’s obvious they’ve never read the Constitution. Or understood it if they did. What the lefties mean is they don’t like pushback on their favored victim classes, in this case mentally ill people who think they’re a different sex than what they actually are.
They use the ‘raycist’ word the same way - means they don’t like that you disagreed with them and they don’t have a rational, logical argument against your position.
DOJ doesn’t decide what is and isn’t constitutional.
The "evidence" is deeply unserious advocacy masquerading as research.

There’s precedent for the Supreme Court making lawful determinations as to what is or isn’t Constitutional.
By what mechanism does the DOJ think it also has that authority?
I taught the Constitution to Jr High students for over 25 years. We went through it line by line. I can guarantee that the word ‘transgender’ does not appear in the document. Even the 14th Amendment doesn’t include it.
I have neither read nor heard of any state restricting the rights of transgenders. Some states have passed laws saying that when it comes to bathrooms, locker rooms and sports teams people are restricted based on the wedding tackle they were born with, not what they wished they’d been born with.

It looks like the Demonrats are gutting their promises to the leftists by using the DOJ to gut their legislation.
I will take the win happily but the use of this underhanded tactic by the Democrat Party was lifted right out of the GOPe playbook.

Transgender perverts of any age are not any sort of protected class under the intent of the US Constitution. No way. If anything, the Constitution is set up to protect the People from these preverts and their perversion of rights and laws.
By this logic one should be able to claim that he/she have and addictive personality and therefore denying access to heroin is a violation of constitutional rights.

Transgender students are NOT being banned from participating in sports. This canard is a big lie which is told so often that liberals expect people to believe it.
These so called “transgender” people are allowed to compete with people of their own biological sex. The liberals always make it sound as if students are being banned from sports. They are NOT being banned from sports.

I agree with you 99.9%. There might be an exception for people born with male tackle but have Klinefelter's syndrome which is a Y chromosome and 2 X chromosomes. People with this disorder are born male but at birth they are often sex reassignment surgery to female, The condition is characterized by abnormal sexual development, with malfunction of the testes and reduced testosterone levels. As males grow up, they tend to be taller than average but have reduced muscle strength. Learning ability may be impaired and there may also be some delayed development of motor skills. Males with the condition may also be infertile.
