Calls grow louder for Breyer to retire after McConnell vow

Democrats and progressives stepped up their calls for Supreme Court Justice Stephen Breyer to step down Monday after Senate Minority Leader Mitch McConnell (R-Ky.) said he would not permit a vote on a potential Biden nominee if Republicans control the chamber in 2024.

“I don’t think either party, if it controlled [the Senate], if it were different from the president, would confirm a Supreme Court nominee in the middle of an election [year],” McConnell told radio host Hugh Hewitt.

The Kentuckian then raised the stakes by refusing to commit to giving a Biden nominee a vote in 2023 if Republicans retake the Senate in next year’s midterm elections, telling Hewitt, “We’d have to wait and see what happens.”

McConnell’s comments led to outrage on social media, with Rep. Mondaire Jones (D-NY), tweeting: “When I became the first person in Congress to call for Justice Breyer to retire now, while President Biden can still appoint a successor, some people asked whether it was necessary. Yes. Yes, it is.”

“Certainly feels good to yell online about this, but the only audience that really matters is Stephen Breyer, [Sen. Joe Manchin], [Sen. Kyrsten Sinema], and a handful of other Senate Dems who are hiding behind them,” added former Obama speechwriter Jon Favreau, referring to two Democratic senators who have spoken out against eliminating the filibuster. “Anyone got a plan to persuade that crew?”

Yeah, I agree. I don’t recall a single Justice — on either side — ever listening to this sort of call for strategic retirement and “taking on for the team.” They quit when they want to quit. Period. O’Connor quit for family reasons, and regretted it. Kennedy wanted out for a long time. He had done has dirty work as the Rosa Parks of gay marriage and was ready to move on. Most of them have monstrous egos. Being a SCOTUS Justice has a lot more cachet than being a retired SCOTUS Justice. The job pays reasonably well and involves no heavy lifting. As Rehnquist and RBG proved over the years, it’s also a job that’s possible to literally “phone in” even while gravely ill.

I’m not sure that it is that stupid. I think McConnell might be baiting Breyer to quit so that Biden can pick some Black female judge (the current name I’ve heard is Judge Katanji Brown Jackson of the US District Court for the District of Columbia, who has been nominated to the DC Circuit). I imagine that Biden would like to pick Michelle Obama or Stacey Abrams (both graduated from law school and actually passed the bar examination somewhere), but those nominees would be utter disasters for the ‘Rats (which is why I hope Biden nominates either of them)

I sense that when this judge (whomever it is) comes up for a real confirmation hearing where she will get real questions from straight shooters like Mike Lee, Tom Cotton, Ted Cruz, Josh Hawley, Marsha Blackburn and John Kennedy, she will be shown to be to be intellectually and morally inferior to Kamala Harris (if that is even possible). Even if the nominee squeaks through on a 51-50 vote, all the ‘Rats in the Senate will be besmirched (I’d probably be called a racist if I used the verb “tarred”) with this Che Guevara in a judicial robe.

So you believe that by McConnell baiting Breyer into retiring Dems would embarrass themselves with some wacky nominee? The only problem with that is that the Dems wouldn't be embarrassed and 20 years from now that wacky nominee would still be sitting on the bench. McConnell didn't do anything other than offer Breyer another reason to retire.

Do you really think this current crop of Democrats care about whether they are "besmirched"?

They're out and out Marxists. They are driven to kill off this country. Their stock and trade is lying. They have no morality at all and therefore no honor.

It was good O’Connor retired when she did. It was reported that around 2013 that she had developed dementia. But who knows? If she had stayed on the SCOTUS, it might had kept her mind sharp!

Doing it isn't stupid. Announcing in advance that you are going to do it is. All he did was provide the Dems with a perfect sound bite to increase turnout in the next election.
