MINNEAPOLIS — The woman who was in the vehicle with the man fatally shot by members of a U.S. Marshals Fugitive Task Force earlier this month says she never saw a gun in the man's possession, nor did she ever see a gun inside the vehicle at the time of the shooting.
On June 3, law enforcement shot and killed a man, later identified as Winston Smith, at a parking ramp in Uptown Minneapolis. According to a news release from the Minnesota Bureau of Criminal Apprehension, the task force members — who were deputies with Hennepin and Ramsey County sheriff's offices — said they opened fire after Smith fired at them through the rear window of his vehicle. A 27-year-old woman was inside the vehicle during the shooting, and was transported to an area hospital after sustaining injuries from the glass.
On Thursday, Racey Rodne, who is one of the attorneys representing the 27-year-old witness, held a press conference in Minneapolis to read a statement on behalf of his client.
"She never saw a gun on Winston Smith, and she never saw a gun inside the vehicle at any time," read Rodne.
According to Department of Public Safety (DPS), Smith was being sought on a warrant for a felony firearms violation.
The BCA, which is leading the investigation, said in the earlier press release that evidence "indicates that the man fired his weapon from inside the vehicle. BCA crime scene personnel recovered a handgun as well as spent cartridge cases from inside the driver’s compartment."

You are one of the few on here that realize that fact. This may have been a criminal thug who shot at cops or that part of the story might be entirely fabricated. Yes kids, the police are just another part of government and they are no more trustworthy than any other part. I'm not saying they are lying in this case. I'm saying that at this point their side of the story is no more credible than this witness. Don't believe me? look up the case a few months back in Houston where cops raided a married couples home at night and killed both of them claiming the occupants shot at them with a .357 revolver. The only problem was, the narcotics officers fabricated the entire story. It was flat out murder and for what reason we still don't know.
This statement by the "BCA" sounds a little odd.

So what they are saying is this is our story and we're sticking to it. This statement has clear wiggle room built into it. Why not just flat out say the man fired at the police from inside the vehicle? It sounds like they are saying the evidence made it look that way but we are stopping short there.
What make and caliber was the weapon? Why the lack of transparency?

Test the dead suspects hands for powder residue. Notice no mention of that? If he fired a handgun at them from inside the car he's going to have powder residue all over him.

This statement sounds very odd in that they don't say they were fired upon by the suspect. There are no statements by any of the officers involved to the extent the suspect shot at them. Only later in the article is the statement from the BCA that the evidence looks like the suspect fired from inside the vehicle because they recovered a handgun and spent shell casings. They statement goes on to say it's not clear if the firearm recovered had been fired during this encounter! WHAT?
Read this statement.
"Early stages of the BCA investigation found evidence Smith fired his weapon from inside the vehicle; the BCA reported crime scene personnel “recovered a handgun as well as spent cartridge cases from inside the driver's compartment.” It's still unclear whether the gun was fired during this encounter or not. The investigation is still underway. "
The BCA is clearly covering themselves and likely already suspect this gun and shell casings may in fact be a plant.
There is no way an investigating unit would say they are not sure the gun and spent shell casings recovered from inside the vehicle had been fired. They know something does not look right and if you couple this with the girl in the vehicle saying she never saw a gun then all the sudden this thing stinks to high heaven.
I'm not saying this is a definite cover up but things are already not adding up. I know how to spot police shenanigans and this is not looking good.
Now at this point this could be just really bad and unfortunate reporting but you have to scratch your head when a witness says she never saw a gun and the investigating unit says they recovered a handgun and spent shell casings but they are not sure the gun had been fired during this encounter.
Why does a witness need an attorney?

It may be too late now. I have shot an M16 inside a room without hearing protection (in the 1970s). I could not hear for about 15 minutes, but was fine the next day.
On a similar note, in the old days when cops carried 357 Mags, every cop that fired his weapon inside his vehicle had permanent hearing damage.
#25. If Winston fired a handgun from inside his car out the back window, including points you raise, they police forensic team should be able to address the following questions:
1. Did the suspect fire a gun at all? Gun powder residue should be on his hands, face, clothing, car seat, back seat and possibly the rear window.
2. Was there a hole in the back window and if so, does it show that the bullet came from within the car (the glass would be blown out as indicated by the details of the entry/exit hole/size/impact direction, etc.
3. Was there a gun recovered inside the car or just outside of it? If so, where and was there a fingerprint/s on it? If so, whose print(s) were they?
4. Was there a bullet casing recovered inside or just outside of the car (and if so, did it have a fingerprint on it?
5. Was there a smell of gunpowder inside the car after the police opened its doors?
6. Any cam films, tapes, esp. of the gun shot from within the car, available, etc?
7. Has the girl been offered a lie-detector test? If so, did she accept or reject? If she rejected it, was it her idea or that of someone else, including Winston’s/or her attorneys?
IF she took one, what were the results or are they going to be revealed to a grand jury or trial jury/judge?
8. How about a Voice Stress Analysis test? Same questions.
9. Were there any police or other eyewitnesses to any shots being fired from within the car, the shattering of the rear window, smoke coming out of the car from the shot, or did anyone (if they were close enough) hear a shot from the suspect?
10. Has the girl been warned what the penalty for lying to the police during an investigation is, as well as lying under oath before a grand jury or in a court hearing/trial?
11. Given Crumps record of unethical practices, has anyone moved to have him disqualified as a lawyer for the suspect’s/girlfriend’s family/s?

it’s the federal government. give it up! they do whatever they want, whenever they want, to whomever they want, for whatever reason they want. AND THEY ARE NEVER HELD ACCOUNTABLE. Anybody know the name of the federal government thug that shot and killed Ashli Babbitt? I didn’t think so, nor do I believe we EVER will! She was unarmed and he murdered her. But when you work for the federal government you are allowed to do that. It’s VERY simple... the “founding fathers” created a “republic” in which you were a human being with certain “inalienable” rights. Now! The federal government is simply a tyranny built upon propagating itself. It is now a “LIVING EVIL” thing that destroys anything and anybody that jeopardizes it’s continued growth.

Ya I would say do so more reading before taking sides. Maybe read my post number 32. In a nutshell the state investigative unit has a gun and shell casings recovered from the vehicle but can’t say if the gun had been fired during the incident. Then we have the witness that is saying she never saw a gun on the suspect or in the car and she was in the car with him. Put those two things together and something is beginning to smell bad. Why would this guy have a gun in the car with shell casings fired from that gun when it had not been fired from the car? At the same time girl says she never saw a gun? If the state investigators are publicly stating they are not sure the gun had been fired then they know something doesn’t look right and they are covering themselves.
