Last Friday, a San Diego-based federal court overturned California’s three-decade-old ban on so-called assault weapons. U.S. District Judge Roger Benitez sided with a number of gun advocacy groups challenging the law, finding that firearms prohibited in the state of California are protected under Supreme Court precedent.

Thirty days is just to allow the state time to appeal. Once the state appeals, the stay will be indefinite. It will take a couple years, and the 9th will likely reverse Judge Benitez. A couple years later, SCOTUS may decide to hear the case, or not...
Judge Benitez's slapdown of CA's magazine capacity limit in Duncan v Becerra was 2 years ago, and it was recently upheld by a 9th Circus 3 judge panel, only to be vacated again. Now we wait for an en banc review by the full 9th. All the while, the stay remains in place, and Californians are denied 2nd amendment rights.
Now, if the en banc review of Duncan v Becerra goes our way, then the AWB might go down in flames also. That's the case to watch and see where the 9th stands.

I will say that I’m encouraged that this particular Supreme Court may actually take up a case like this. There are bans in various parts of the country that have had their day in court. Ideally, the 9th Circus would uphold this ruling and California would appeal to the Supreme Court. You then have a state appealing (which is always a powerful draw for SCOTUS intervention) and a hard circuit split. But it’s a crapshoot with the 9th Circus. It’s such a large circuit that you never know exactly who will wind up hearing a case. And en banc is a whole other can of worms.
Anyway, we definitely have the votes to strike this law dead at the SCOTUS. We just have to hope they’re willing to take up the case at all. I would love nothing more than to see expansive binding precedent that this kind of nonsense doesn’t fly.
