A federal judge tossed charges against a New York man accused in the Capitol riot — the first out of hundreds of cases to fall apart due to lack of evidence.
Prosecutors wrote to the Washington, DC, judge on Tuesday asking to drop charges against Christopher Kelly, a New York City resident who was captured in a viral photo near the US Capitol, shirtless and holding an American flag, according to court documents.
Kelly was busted in January after the FBI said it obtained information from a paid informant that showed he had taken a photo from inside the Capitol building during the Jan. 6 siege.
Kelly also allegedly boasted to several friends in a Facebook messaging group that he was in the nation’s capital that day with “ex NYPD and some proud boys,” according to charging documents.
The charging documents included the viral photo that showed a shirtless Kelly holding an American flag near the US Capitol — but did not include any photos of him inside the building during the siege.

Paid informant. That is a paid rat that needs to be exterminated. The government should not be allowed to use paid informants. They are untrustworthy with greed being the motive. They needlessly ruin peoples’ lives. If an informant wants to come forward on his own when a crime is involved, then there is another name for that: witness. I have no problem with that.
the paid informant should be doxxed and have his arse sued off of him at the very least. Hope this guy launches a lawsuit of his own for unjustified arrest/being charged with no evidence.
How about prosecuting the lying FBI agents who lied in filing of charges against him? There should be no limited immunity for thugs with a badge.
Hell yeah lawsuits ... anybody held for weeks on flimsy evidence like this case should sue the mutha-fooking Feds for millions. Jobs may have been lost and certainly reputations. Additionally having a Fed arrest on your record impacts many other aspects of your life, credit score, etc.

Think eventually these people arrested for the largest insurrection since the Civil War will have their cases dismiss as there is far to much very embarrassing things that to be found in discovery they won’t want known and more and worse that would come out by their agents and informers questioning under oath.
