Is a guidance now law?
Stating the obvious: No. And so goes my prior comments on this topic, only an act of Congress can shield employers from the looming liability on a number of issues, including wrongful death and, most-pertinently here, discrimination:
“The EEOC also said employers are required to keep their staff’s vaccination information confidential.”
Gee: I wonder what those masked employees in the back of the building are doing? Could they possibly be ‘unvaccinated’?
