It is not a HIPAA violation to ask if someone is vaccinated


Of course it isn’t. That would violate the first amendment. You can ask anything you want. HIPAA just precludes you from requiring me to answer.

HIPAA doesn’t even do that. HIPAA is worthless.

Actually HIPAA does not preclude your right to not answer. It is your basic right to not disclose anything about you. It’s privacy. HIPAA only applies to the transmission of protected data from entities requires to maintain confidentially. An individual person has no HIPPA duties.

And a person can always waive HIPPA.

To be clear no one has a duty to disclose any of their personal health data if they do choose. Even though I have posted on this forum that I am vaccinated snd happy that I was, when asked in public by the Karen’s I simply stated it’s not your business what my personal health choices are. This is because I fully believe that most of not all private information should be controlled by the individual. There are statutory exceptions for example I have to report a rabies case to the health department but in general i support the answer by anyone declining to answer intrusive questions.

no it doesn’t. HIPAA applies to health care entities and a few of their contractors sharing your health information without your consent. it has nothing to do with any question asks of you or your answer to such a question
