As more people get their COVID-19 shots, many are finding themselves in a position of having to ask others about their vaccination status.
Some are wondering if this violates the Health Insurance Portability and Accountability Act, or HIPAA.
Ellen Cihak has not been asked if she is vaccinated against the coronavirus. She also hasn't been asked to show proof in Appleton stores.
"I would like to see that happen. I don't know if it's legal to do that," said Cihak.
Like many others, Cihak doesn't know if the question violates HIPAA.
John Fisher is a health care attorney who specializes in health care compliance and ethics. He says although the vaccine status questions might be uncomfortable, it does not violate HIPAA.

Parents are required to show proof of half dozen vaccinations before their kids can get into school...public or private.
Proof of vaccination can be required for many things.
International travel is another.
But I don’t anticipate it will be required to conduct commerce. In fact, I’m sure it won’t.
And the commercial enterprises that now “require” it will have to negate that requirement to survive.
Exactly. The article is very carefully crafted propaganda.
I thought of the same thing. If they ask "have you been vaccinated?" You can honestly and truthfully reply, "yes".
I don’t actually own a restaurant, but I’d let you in no matter what.
I understand the etiquette and the legal aspect Unique refers to, but I suspect, don’t know for sure, but I think these questions are coming from Christian/moral people who are uncomfortable with lying. They may not even be ethical absolutists, “lying is always wrong and there are no conflicting norms”, they may come from a social or family framework where they do not have to confront a moral dilemma, and are taught to avoid ANY confrontation dialog or attitude at all. Gotta be polite even to these rude Karens you know.
Better to suggest a “third way” to these folks than to ask them to upset their entire worldview (unless you feel your own ethical worldview is correct and ought to be imposed upon them.)
You don’t have to answer.
“Have you been vaccinated?!”
“Oh thank you for your concern. Have we met? My name is ...” Miss Manners taught us to ignore rudeness.
Perhaps some of them are types who want to fight back but need the justification that this HIPPA idea gives them.
My dear departed mother would have said something like this,
“Oh Dear, I know you mean well, but have you heard about this HIPPA thing? Well, you know that people will just sue you over anything especially these privacy issues! Could you tell me where I can find the items that are on special?”
Thanks for your thoughts!
Excellent ideas.
Interestingly, as A Christian, I understand that God actually rewarded a certain prostitute for lying.
But I like those ideas.
“God actually rewarded a certain prostitute for lying.”
Yes. And she’s listed in the bloodline for Jesus.
Yes. And she’s listed in the bloodline for Jesus.
Not that there are only 8, but most people don’t know that. The geniologies mention very few women. Who they are is amazing.
“HIPAA doesn’t even do that. HIPAA is worthless.”
HIPPA is used by the state when convenient. In doing genealogy research I discovered one of my great grandfather’s was confined to a state mental hospital in 1909. He died in 1937. I wrote to the state hospital asking for his records and proving my relationship as well as his death via state certified death certificate. The reply stated the hospital would not release his records, due to HIPPA, without a notarized statement from the patient, or the patient’s guardian (my uncle who died in 1968). I pointed out the fact all of the people they want statements from are long dead. The hospital stated they have to follow the law. My only remaining order is to obtain a court order directing them to release the documents.
In other words, the bureaucrats don’t want to be bothered.
My answer is to ask (if a man asks) “Did you get a vasectomy?” or if a woman asks “When was your hysterectomy?”.
I figure if they are comfortable enough to ask me personal medical questions I can ask the same of them.
That page led to another page with a list of links to states: https://www.huschblackwell.com/newsandinsights/50-state-update-on-pending-legislation-pertaining-to-employer-mandated-vaccinations#:~:text=The%20Bill%20provides%20that%20a,Committee%20on%20April%209%2C%202021.
I clicked on Virginia and the laws are pending.
It is not illegal for someone to ask if you're vaccinated and it's not illegal for you to tell them that it's none fo their business.
I Will Lie if
You make
Good Fish Tacos!
How about the 4th amendment?
For future reference, what is the name of that restaurant so that I can be sure to avoid going there?
The 4th Amendment requires government action. It doesn’t apply at all to these corporate tyrants.
Anyone who asks me about vaccination will get a “Did you get you STD shot yet?” Are the sores still visible and does it still hurt when you pee?”
No...but it could get you shot in some places. For real.
It's probably because key players in the company aren't buying the BS and will tell them to stick their questionable injections up their butts.
