Oklahoma Considers Law Reform to Allow Defensive Escape by Motor Vehicle

One of the tactics used by the far left to disrupt the lives of private citizens and to show their power, is to block roadways, streets, and public right of ways. Blocking public right of ways has been a minor crime. Most states have statutes that require vehicles to give way to pedestrians.

The far-left found this weakness in the system, which allowed them to disrupt and endanger tens of thousands of other people without serious penalty for themselves.

Once vehicles were stopped, the drivers and passengers would be at the mercy of the mob. Several drivers have been beaten. Others have been shot at. The mobs appear to have been taught tactics to incite drivers to attempt to escape, and then to claim “victim” status. There are numerous videos that show “protestors” running to get in front of vehicles to stop them and render them vulnerable to the mob.

Several state legislatures have recognized this flaw in the system, which allows groups of people to terrorize the public and to cause fear and death, as emergency vehicles are diverted or delayed from reaching hospitals or those in need of emergency care. AP reports bills are pending in Iowa, Missouri, Utah, Florida, and about a dozen other states.

Oklahoma is one of those states.

Representative Kevin McDugle has introduced a bill, HB2215, to rectify the situation and allow drivers to escape threatening situations. If shown to be justified, drivers would be immune to lawsuits and criminal penalties. The bill passed the initial committee hearing 6-1.  From Billtrack50.com:

The bill has been passed and signed into law. A similar bill was passed and signed into law in Florida.

I can fire 52 rounds from my truck without changing a magazine, 122 total. They will have to climb over a mound of bodies to get me out.

The right to self-defense is inherent in human nature. No government can grant it, or take it away.

If antifa/blm are surrounding you, pounding on your windows, breaking some, threatening you, and shooting at you, and you are White with a MAGA hat you will be thrown in jail for life.

If blm stops a truck with a White guy in it, breaks in, and beats him to a pulp, they will not be prosecuted and will be interviewed on Oprah, and then go on to a job at CNN.

I firmly believe that in some states it could be argued that not only is such a scenario (as pictured above) is ‘fear of imminent harm or death’, but that it also demonstrates kidnapping.

Unfortunately, in my state there is a statute for neither.

The only defense in my state for hitting the truck’s accelerator would be under ‘Coercion’ and/or ‘Menacing’ statutes. It’s rather pathetic, but this is Oregon, after all. I’m certain that other states have equally-pathetic statues, which is resulting in new laws as cited with the OP.

Additionally in my case, absent prosecution in one of my state’s rural counties, violation of the cited statutory violations by a ‘protestor’ would not likely be prosecuted (e.g. ‘blue’ urban jurisdictions). I fully expect that should I encounter such a situation and flee for my life by hitting the accelerator, my vehicle will be cited as a deadly weapon and I will be prosecuted as such under my state’s generous pedestrian laws, likely also under murder in the second degree. Thankfully, Aggravated Vehicular Homicide is narrowly/specifically scoped to those under DUI.

Bottom line: Know your state’s laws and influence your lawmakers. In my case, absolutely nothing will change.

150 years ago they were called highwaymen.
They stopped stagecoaches.
They could be shot on sight by passengers, drivers, and riding shotgun.
Those laws have been on the books since wheels were invented.
Don’t need new laws for old criminals.
They shoot horses, don’t they?

Those laws are for armed robbers.

Today's highwaymen are more subtle. They run in front of the vehicle to block it, then if bumped, they claim to be the victim and sue, in friendly courts.

The ideal technique is to not mash on the accelerator.
You do not want wheels to ride atop people and bicycles, losing traction, and immobilizing vehicle amidst a crazed mob.

High beams on, lean on the horn, and keep moving at 20-25 mph. Position yourself low in vehicle should thugs take potshots.
The smarter criminals will move aside. Control of vehicle can be maintained. Do not immediately drive home unless vehicle is garaged.

In the moment of a random illegal roadblock my main focus would be on effectively using the 5000 pounds of vehicle.
There is little benefit to exiting the vehicle if one can successfully keep it moving, yet firearms are naturally beneficial.
The increase in social unrest also makes the idea of a heavier truck (with sufficient torque) also a distinct advantage over smaller/lightweight cars.
