That's what I was expecting when I watched the video. But the lieutenant didn't even crack a window when the officers approached. Why the hell not? How are they supposed to explain what's going on?
He sits there like a rock. They get pissed and tell him to put his hands out the car window. He won't do that, either. His refuses for minutes. Why? Especially after the sneak-ass cop-killing with the AR in NM the other day, I would have been wondering what was up as well. Then they tell him to get out of the car--and he wouldn't do that! Why the hell not? Did he think he was special, and that stalling as if he's drunk or up to something isn't going to make things worse?
He was acting the whole time, including when he finally opened his mouth, like a snowflake jackass, and the language in his lawsuit reinforces that impression.
At night, it's just not unreasonable to think that someone who doesn't cooperate in any way is dangerous. I have to say it was an obvious "good spray."
Just FYI, the advice some police agencies and lawyers give for what to do when being pulled over is “place your hands on the wheel in plain sight and do NOT roll down the window or do anything else unless specifically instructed.” This is because of people that roll down the window ahead of time and then shoot the officer as they approach, through the lowered window but before the officer can see what’s going on in the cabin. This may be what he was doing.
