If the Cap Police let them in, the prosecutors don’t have a case. Doesn't really matter. If someone vanadalized they need to be prosecuted. If they stole something they need to be prosecuted. If they attacked officers in way they especially need to be prosecuted.
Pointing out people who were let in and just walked around is a red herring.

Just ask the following question: When has there been in insurrection in the past 500 years without ANY firearms, or even any weapons to speak of? How credible was that unarmed rag-tag group of people in taking over the government when 100,000 military and civilian well-armed US troops/police were within 10 miles?
Leftists, in the 1970s, set off bombs in the Capitol - that was far closer to an insurrection than this non-event (all we managed to do was hang a picture of some black guy sitting on a bed in the Capitol Rotunda). Why wasn’t the bombing called an ‘insurrection’?
Anyway, if that’s not enough, the MEDIA is now backing away from the term ‘insurrection’ and has quietly replaced it with ‘riot’ now. They can’t even say ‘insurrection’ with a straight face anymore.

Called "insurrectionist"?
Lose their jobs?
I agree to prosecute, convict and jail ANYONE who used any violence that day, but how does one sort the wheat from the chaff?
Certainly not by the DNCMedia or social media.
But anyone who was there that day for the purpose of supporting Trump has been branded all of those things.

And the Judge is just as CORRUPT, this should have landed the Lawyer a $10,000 Sanction, Referral to the BAR for Permanent Disbarment, and a Referral for Criminal Prosecution for Defrauding the Court.
