Let's Give Kristi Noem Some Room to Maneuver on Transgender Legislation - She's Not Completely Wrong

Over the weekend, Governor Kristi Noem came under fire from conservatives after refusing to sign a bill prohibiting transgender girls and women from playing in girls’ and women’s sports leagues. This is a hot-button cultural issue, but I would caution my fellow travelers from making snap judgments and employing purity tests. That behavior ran rampant in the 2016 primary, and we see it as a feature, not a bug, when it happens on the Left. While it is understandable that conservatives are often let down by our elected leaders and we have a reason to be skeptical, let’s take a deep breath for a minute.

I watched Noem’s interview on Tucker Carlson Tonight Monday evening and listened to her speak with radio host Glenn Beck Tuesday morning. According to her statements, the bill can go through to protect girls 18 and under in the state of South Dakota but requires some changes related to an individual’s right to sue if they lose a competition to someone who used performance-enhancing drugs. The section of the bill she is asking the legislature to hold off on is the collegiate level portion of the bill.

According to Noem, she has been consulting with legal experts and professors to figure out how she could defend the entire bill once it passed. There are concerns about how the bill as written would fare in the 8th Circuit Court of Appeals and about the NCAA leading a public relations campaign against the state. We saw this when North Carolina passed a bill to keep bathrooms segregated by biological sex. According to CNBC at the time:

Over the past year, North Carolina has suffered financial hits ranging from scuttled plans for a PayPal facility that would have added an estimated $2.66 billion to the state’s economy to a canceled Ringo Starr concert that deprived a town’s amphitheater of about $33,000 in revenue. The blows have landed in the state’s biggest cities as well as towns surrounding its flagship university, and from the mountains to the coast.

What happened to North Carolina spooked other states from following suit, and bills providing sex-based protections in restrooms evaporated nationwide.

Noem is not just protecting stadiums and tournaments. She is saving South Dakota businesses from facing the adverse effects seen in the North Carolina economy. In 2018, North Carolina’s estimated GDP was $566 billion. South Dakota’s GDP in 2019 was $46.81 billion. It would take a much smaller boycott to injure South Dakota’s economy deeply.

Noem is seeking to coordinate with other states to fight the NCAA. There are 23 state governments run by Republican governors and legislatures right now. It should not be controversial to pass legislation supported by the Republican base in these GOP trifectas. Noem has joined with Golfer Nancy Lopez and NFL stars Herschel Walker and Jack Brewer to build a coalition of voters and state leaders to unite on the issue. Can Amazon yank distribution facilities from all 23 states? Can the NCAA take tournaments out of all of them? That would be a lot more complicated.

Yes, there are states considering these bills right now. None have reached the governor’s desk yet (except in Idaho, where a court suspended the law). Protecting girls under 18 in South Dakota while working to ensure a robust and multi-state stand on collegiate sports does not seem like an abdication of the principle. Noem cited her fight against the USDA’s ruling that would have had girls and boys competing in the same rodeo events in 4-H programs. She also noted her willingness to stand up to the lockdown advocates throughout the pandemic.

Please take a deep breath, and let’s see where this goes. There are bills in moving in at least ten states, with more coming on board during their legislative sessions. This issue is not the only one Republican states will have to coordinate on to defend. Should the Democrats end the filibuster in full or in part, state coordination will become even more important to protect religious liberty, the Second Amendment, and prevent a federal takeover of elections. 2024 is a long way off, and we need to get through 2022 first.

No. Giving anyone in the GOP “room” is just asking for disappointment and betrayal. The GOP Is hoping enough of their base voters are so stupid that they will simply forget. The GOP are not to be trusted, double-down on the pressure.

Gov. Noem is protecting her state’s college athletics program from the woke NCAA. As we have witnessed over the years, our colleges have become incubators for the woke mob that has lashed out to ban books and cancel non-woke actors.

When fighting these tyrants, it is important to fight smart and not to give the Left the upper hand.

The concern is that for a good headline, the governor may be sacrificing South Dakota’s ability to host events and participate fully in NCAA competition. Noem has rolled out a different strategy with a more nuanced approach. She is leading a group to defend women’s sports titled “Defend Title IX Now.” The goal is to protect fairness for women’s sports and to protect states and schools that are under attack.

The effort focusses on rounding up states to oppose biological males competing in college athletics without the fear of the NCAA making an example out of one state. Remember how North Carolina reacted when the bathroom controversy made that state the focus of left-wing boycotts and protests – they caved. It seems like a brilliant strategy to get the states to team up and prepare for the fight without the pain of a South Dakota NCAA boycott.

The goal of Title IX was to level the playing field between women’s and men’s sports. Title IX of the Education Amendments of 1972 prohibits sex discrimination in education or in activities that receive federal funds. This has led to more cash flowing to women sports. Any effort to muddle the issue will lead to women’s sports becoming a political football rather than a place for women athletes to strive. Americans should be happy that Governor Noem is trying to both protect her state’s male and female athletes from the woke NCAA punishing South Dakota for passing this law and her efforts to focus on strengthening Title IX.

Maybe Governor Noem’s biggest political problem now is that she is acting like a responsible governor and not a 2024 presidential candidate. Had she only cared about 2024 politics, Gov. Noem would have signed the bill and let her state become a battleground between the radical Left and student athletes. Being a governor, she seems to be trying to avoid making student athletes pay the price for her signing a bill that needs some tightening up.

Either way, this will be a long battle and Gov. Noem will be judged by the results over the next few years. While many conservatives reflexively think the governor should sign the bill, maybe they will seethes as a better strategy over time.

She can easily pull SD colleges out of NCAA certification. Who died and made the NCAA King? Let SD college players compete in intramurals then.
Trump didn’t get dozens of judges confirmed for nothing. Noem panicked. Her economy would have been fine because conservatives would have countered whatever boycott and supported SD.

So what’s the plan? What is the specific language acceptable to Noem? When can we expect a bill on her desk she will sign? All I see here is Noem accommodating the progressive agenda and gaslighitng GOP voters. Not. Good. Enough.

I understand the emotions run high because so many so-called “principled” conservatives have time after time sold out for corporate interests, failure theater, virtue seeking, on and on forever...

Folks, nobody is going to be the perfect politician AND be a winning politician. The whole idea that someone can be elected at a statewide or national level by sticking to rigid principles that align 100% with each voter is absurd. The secret to Obama’s political success was that he looked good without staking out hard political positions that anyone could nail him on.

Trump (lest we forget) was a terrible primary candidate on paper ... until he wasn’t. He also ran through a series of bad advisors, staffers, and miscues. Still, even though he failed to repeal and replace Obamacare, failed to see Hillary held into account for her lawbreaking, failed to stop the ballot harvesting that lost the house and later the presidency, he still accomplished a lot.

Gov. Noem may or may not be pursuing a valiant effort and deliberate strategy, or she may be selling out. I think it’s too easy to give in to the hot take world of immediate reactions and excommunication for the insufficiently pure. Pursuing a limited but firm win at the state level and at the same time trying to get an interstate coalition to take on the national-level issue sounds right to me. Maybe it’s not. 2024 is a long way away and right now there are no declared candidates, not even Trump at this time. I am watching and listening though, and keeping an open mind.

Well, she was completely wrong, but she saw what was going to happen to her political future and backed off.

If she really has been working on this issue for years, why didn’t she work with the legislature to shape their bill?

According to one report I read her staff lawyer signed off on the bill long ago and was hands off during the legislative process. She chickened out without a doubt. We need lions and instead have kittens like Krist Noem.
