Michael Sherwin, the federal prosecutor who until recently was leading the criminal investigation into the Capitol riots, told CBS' "60 Minutes" Sunday that evidence indicates sedition charges will be laid against some suspects.
Why it matters: Few people have faced this Civil War-era charge, which makes it a crime to conspire or overthrow the government. But Sherwin told CBS' Scott Pelley "the evidence is trending towards that" charge "and probably meets those elements."
"I believe the facts do support those charges. And I think that, as we go forward, more facts will support that," he added.
Of note: During his interview, Pelley asked Sherwin if investigators were looking into former President Trump's role in Jan. 6 insurrection. "We have people looking at everything," Sherwin replied.

I was there it was pretty mild from what I saw . Everyone was very nice and if the police had done their job nobody would have gone inside. Antifa was definitely there as you could see morons with masks on. That being said I think we should have started the revolution that day. Our country doesn’t deserve this and neither do we. We are not a communist country.
Antifa and BLM openly advocate overthrowing our institutions, yet they escape these kinds of charges.
But having your son operate as bagman for CCP bribes isn’t sedition.

Wouldn’t surprise me if some of them made wild statements that would support the charge.
However in the interest of justice and the nation I don’t think they should be pursued.
The NY AG is a little busy with the Cuomo stuff right now.

Antifa, BLM and other groups such as “ShutdownDC”, “Refuse Fascism”, etc. are communist and/or anarchist organizations whose goals have to be, re their very reason for existing, is to “overthrown the government”.
Seems that Sherwin is a little light on his Constitution and history and very heavy on “maybe” “pointing that way” and “I am an incompetent ahole”.
They’re trying to scare some of them into going along with a script prepared by the socialist Democrats and their allies.
By contrast all over America in 2020 radical leftist BLM protestors urged actual revolution and the overthrow of the government.
Every defendant in this case should demand a change of venue to the smallest Federal District Court in Nebraska or Kansas. They don’t stand a chance with a Feels Up/Heels Up prosecutor and a DC jury.
Apparently Biden’s buddies the Iranian Rev. Guard were planning an attack on Ft. McNair and US officials in revenge for Soleimani, when all this was going on in January, and this “riot” response enabled the politicians to have cover for ramping up security in DC.
Well I've always been against the independence of the DOJ. But yes, an independent (unconstitutional) DOJ is a political monster.
