Biden admin to be sued by red states over revocation of Keystone XL permit, suit argues president lacks authority

A group of red states will file a lawsuit on Thursday against the Biden administration for revoking the permit for the Keystone XL pipeline, which the president did via executive order on his first day in office, Fox News has learned.

The lawsuit, first obtained by Fox News, is led by Montana and Texas, and backed by 19 other states, including Alabama, Arizona, Arkansas, Georgia, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, West Virginia, and Wyoming. It names President Biden and several of his Cabinet secretaries as defendants.

The lawsuit says that the president in issuing his Jan. 20 executive order and his Cabinet officials in enforcing it are exceeding their authorities under both the Constitution and the Administrative Procedures Act (APA). ...

At the very least, Joe Biteme did not follow the Administrative Procedure Act, did not give the stakeholders in the Keystone XL project fair notice and a right to be heard, and generally acted arbitrarily, capriciously and contrary to law.

It looks like, according to the law, those states are correct. Obama had 60 days to kill the pipeline but did not.

However, finding a judge who would rule in these states’ favor in an entirely different matter.

When will the Governors of the states finally begin to act independently of the rogue illegitimate junta in DC? If the Keystone Pipeline and firearms restrictions are important enough for the states to ignore the illegal USSC rulings and Executive Orders, then it is certainly much more important to finally get rid of unfettered abortion, affirmative action, homosexual pseudo-marriage, forced euthanasia, and so much more that are abominations and travesties foisted on the states by an illegitimate and out-of-control US government. Let freedom ring! GOPee Delenda Est!

Anyone remember judges coming out in the beginning of the Trump admin and boldly claiming he had no authority? I do. Those same judges would gladly rubber stamp any Biden decree.

Curious question for all the lawyers out there. Why wasn’t this case filed in several different district courts, thereby setting the potential for divergent circuit rulings and forcing it into the hands of the Supreme Court?

Lacks authority? I believe the “new” pass is given when you claim “lacks standing”..... Ask John Roberts.... He could rewrite it all for you and ok it though.
